Wait: I am writing to respectfully ask you to use the full extent of your authority to stop Helen and Case Simpsons'willful and continuous neglect of 65 and 69 Phila Street. I believe it is within your jurisdiction to compel the Simpsons to preserve the integrity of the buildings, restore them, or to sell them to someone who will,just as other property owners in this Historic District have done for the past 40 years. Please do not reward their intentional neglect with demolition. My family owns and manages 61 Phila Street (the apartment house next to 65 Phila). We were among the first in this neighborhood to take on restoration. In 1982, 61 Phila was an uninhabitable 32-bedroom rooming house.Various members of our family have consistently lived at 61 Phila over the past 36 years. We know the commitment it takes to restore a historically significant building and the value that doing so brings to the property and neighborhood. We know what it is to live in one of the Historic Districts that contribute to the value and character of Saratoga Springs. Your Court seems to be the only Saratoga Springs authority to elicit a�n i action from the Simpsons and that response is slow and minimal. I am including with this letter pertinent pages of the October 27, 2004 Saratoga Springs Zoning Board of Appeals (ZBA) and December 9, 2020 Design Review Committee (DRC) minutes. While the actions of other boards, committees and councils may be beyond your purview, I implore you to read these minutes, along with the many letters submitted to the (DRC) in opposition to the Simpsons' application for demolition, (online with the DRC agendas). They're a sample of the 26 years of City records documenting the Simpsons' long history of: -total inaction when applications for area or use variances are granted; -applying for variances and permissions to demolish or build new rather than to restore existing buildings; - intentionally neglecting the properties,with a long-term goal of"demolition by neglect" (Note Case Simpson's October 27, 2004 response when a ZBA member asked about other options to save the buildings: "demolition is always an option or he could board up the buildings and can leave them for years".) - making no good faith effort to sell the properties, even refusing full cash offers from qualified buyers interested in and capable of restoring the properties; -complete disregard for the impact the condition of the buildings has on neighbors and the City, not simply as a result of neglect but by making non-compliant modifications such as removing structural walls in 69 Phila, using chain link fence, chipboard and chicken wire to repair rather than make structural improvements; - "playing" (for lack of a more sophisticated term)one set of City officials against another while laying blame between the entities for their inability to comply and always implying unsubstantiated hardship; and -showing absolutely no respect for and consistently wasting the time of many people, over many years who serve on the various Saratoga Springs boards, committees, councils and within departments, agencies and even your Court by consistently appearing unprepared or naive of what is required of their application or petition. Why is this allowed to continue? What is the message for property owners and taxpayers throughout the City who abide by the laws, codes and ordinances?Something needs to be done when fees,fines and penalties aren't motivating. Please take enforcement action that demonstrates the City's respect for and protection of all the responsible property owners and taxpayers. Funiciello 02/08/2021 page 1 In response to building code violations and Court orders, the Simpsons reach agreements with the City that allow them time for applications to the ZBA or DRC without requiring them to see the applications through to completion.They come unprepared to DRC and ZBA meetings and require or request adjournment. It seems obvious that they are intentionally procrastinating in attempts to force demolition. If the buildings are allowed to come down without enforcement effort to preserve them, it will permanently degrade the character of the neighborhood my family invested in and has lived in for decades. If that happens, there will be two more vacant lots in the neighborhood and the Simpsons will be free of all fines and penalties. Your decisive action is needed to enforce all City building codes and ordinances, including Historic Review ordinances as they apply to 65 and 69 Phila. Please order the Simpsons, once and for all,to stop the neglect and promptly stop further deterioration.Their only other alternative should be sale of the properties to people willing to work with City officials and agencies to undertake restoration. Please don't enter into any more agreements that allow more time to pass with continued neglect. I am grateful for your time in reading and considering this. I would be happy to provide further documentation and testimony to support the statements I make here, although, again, most of the documentation is contained in the City's public records.You will note that many of the people who have written to the DRC in recent months are the same people who have been speaking up in the public forum since 1994.
