We further request that this letter be read into and made a part of the record of the Planning Board Meeting dated May 12, 2020. 1. The Special Use Permit ("SUP") shall only be issued for a one year term, with detailed conditions, examples of which are set forth below, with applicant/owner to make application prior to the expiration of the end of each year, to extend for another year. This removes the burden from the City and the neighbors, and places the burden on the owner to demonstrate compliance with all conditions of the SUP, and in general being a good neighbor. The renewal would be by PB appearance and noticed, as customary, with neighbors able to oppose based on operations to date, complaints lodged and incidents reported. 2. Owner's failure to timely make application by the date of expiration, the SUP is extinguished, and null and void, with new application for a SUP then to be required. 3. Applicant waiver of any right to hold/convene any and all commercial indoor and outdoor activities such as wedding/receptions/showers, business meetings, catered events and the like. This language, while present in the SUP provision at issue, was waived by applicant and her attorney at the first meeting before this Board. 4. This Property shall only operate from April 1 to October 31 of each year("Period of Operation"). During "off season"!period beyond, no one other than a caretaker and his immediate family may reside at, or otherwise utilize, this Premises. 5. There shall be no outdoor music, nor music inside projected or amplified to the outside, at the Property. Mr. Mark Torpey Robin Lauder, LLC Special Use Permit Conditions Page 2 of 3 6. No exterior improvements whatsoever shall be made at the Property including the 3 pervious pavement parking spaces, due to the fact that: i. the proximity of the parking spaces to our gas Grill and Patio is approximately 10 feet away. ii. cars parking there will adversely affect the air quality of anyone standing at the Barbeque Grill and/or sitting in a Patio Chair; this will certainly be the case where a car reverses into one of the proposed parking spaces. iii. the distinct possibility of car lights of cars parking in those spaces shining through the hedge into our living room at night. iv. deterioration of our quiet enjoyment of our Barbeque and Patio area caused by car engines and car doors being closed/slammed. We have attached a schematic and photographs of the area for your reference. We also ask that no indoor improvements be made which could be visible from the outside. and no additional outdoor lighting be installed. 7. Impose a limit on the number of individuals to be permitted to reside, or congregate, at the Property in any single 24 hour period of 25 individuals, with the use of the Premises to be for personal, intimate use, not wild parties, with a curfew for all outdoor activities of 9:00 PM. 8. Lighting emanating from the Property shall not exceed ambient lumens for the immediately surrounding neighborhood as measured at the boundary line of the Property closest to the home on the Property. 9 Sound emanating from the Property shall not exceed ambient decibel levels for the immediately surrounding neighborhood as measured at the boundary line of the Property closest to the home on the Property. 10. All vehicles for persons at the Property, including any deliveries, shall be parked and maintained on the Property, with no street parking to be permitted. 11. Delivery vehicles/ food service shall be limited to one such delivery per week, which shall occur only on a business day between 9:00 AM and Noon. 12. Portable/temporary bathroom/toilet facilities are absolutely prohibited. 13. Erection of or maintaining outdoor structures, including without limitation, tents or enclosures is strictly prohibited.
