ELIGIBILITY:To apply for relief from the City's Zoning Ordinance, an applicant must be the property owner(s) or lessee, or have an option to lease or purchase the property in question. The Zoning Board of Appeals (ZBA) shall not accept any application for appeal that includes a parcel which has a written violation from the Zoning and Building Inspector that is not the subject of the application. 2. COMPLETE SUBMISSIONS:Applicants are encouraged to work with City staff to ensure a complete application.The ZBA will only consider properly completed applications that contain I original and I digital version of the following: ❑ Completed application pages I and 8, the pages relating to the requested relief(p. 2 for interpretation or extension, pp. 3-5 for use variance, pp. 6-7 for area variance), and any additional supporting materials/documentation. * HANDWRITTEN APPLICATIONS WILL NOT BE ACCEPTED* ❑ Completed SEQR Environmental Assessment Form —short or long form as required by action. http://www,dec.ny.gov/docs/permits_ej_operations_pdf/seafpartone.pdf ❑ Detailed "to scale" drawings of the proposed project—folded and no larger than 24"x 36". Revised 01/2019 ZONING BOARD APPEAL APPL ICA TION INSTRUCTIONS PAGE 2 PUBLIC HEARING ADVERTISEMENT The Zoning Board of Appeals is required to hold a public hearing on each submitted application within ninety(90) days from when it is determined to be properly complete by City staff. City staff will prepare a legal notice for the public hearing and arrange to have the public hearing announcement printed in The Saratogian legal notices at least 5 days before the hearing. Applicants must pay The Saratogian for the legal ad and present proof of payment to the ZBA prior to the public hearing. If proof of payment is not presented prior to the hearing, the hearing will be cancelled. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood character for the following reasons: THE REVERSE OF THIS QUESTION IS TRUE. We invite the Zoning Board and Planning Board members, along with the Staff, to visit the site and view it from both the Seward Street and Van Dorn Street side. The property extending between Seward Street and Van Dorn was formerly known as 66 Seward Street but is now known as 46-46A Seward Street and is City of Saratoga Springs Tax Parcel No. 165.34-1-9. ("Seward Street Lot") The separately deeded vacant parcel to the south on the west side of Van Dorn Street is 61 Van Dorn Street being City of Saratoga Springs Tax Parcel 165.34- 1-7 ("Van Dorn Lot") Presently and historically, on the northerly parcel, there exists on the general northwesterly corner of the property, a single family residence. To that structure's immediate northeast is a detached garage with a residential apartment above the garage. Attached to the garage and extending to the south is a residential bungalow. Finally. along the southerly boundary of the property is a building that has been used for close to 60 years as a Nursery School/Day Care Center for approximately twenty (20) children. Exhibit"A". Attached as Exhibit"B" is the Affidavit of John L. McMahon, who has practiced law in the City of Saratoga Springs since 1956. He and his wife, in 1957 and 1958, resided in the Bungalow on the Property and he knew the people who resided in the single family residence and the garage apartment during that time frame. He also represented the Property owner in 1971. In his affidavit he described the three residential units on the Property and the Day Care/Nursery School use of the Property prior to 1960 and subsequent to that date. Attached as Exhibit "C" is the Affidavit of Steven J. Sbardella, who is the Managing Member of Top Dog Enterprises LLC, who acquired the Property from Rose Tate on May 21, 2019 and who swears that the configuration and potential usage of the Property is exactly the same in 2020 as described in the • John McMahon Affidavit. It is the Applicant's contention, based on these Affidavits, that the placement and usage of the structures on the Property extends backwards continuously beyond 1960 thus making those uses and the placement of these structures pre-existing, non-conforming uses under the Zoning Codes of the City of Saratoga Springs. Thus,the historic permissive use of 46-46A Seward Street, Saratoga Springs, is for three(3) residential units and a detached commercial Nursery School/Day Care. With the use of the vacant Van Dorn Lot there could be the permissive use of four(4) residential units and the daycare facility on the combined lots. The purpose for this proposal and Application is to decrease the mixed residential/commercial use of the Seward Street Lot and to enhance the streetscape of the north terminus of Van Dorn Street. The Project would create four(4) Lots. The property facing Seward Street would be subdivided into a 12,500 sq. lot with 100 feet of frontage upon which the principal historic dwelling with detached garage apartment would continue to exist. On the remaining combined land, the residential bungalow that is attached to the garage apartment will be removed as will the commercial daycare building. In their place to include the Van Dorn Lot the combined remaining land would be subdivided into three (3) residential lots each being 7.635 square feet in size with the 61.47 feet of frontage. The attached subdivision plan, Exhibit"D", depicts a building window on each lot and Exhibits "E", "F", "G" and "H" show the types of single- family residences that will be built within those building window. The Seward Street lot is consistent with its neighborhood especially in light of the Apartment Complex which is directly across Seward Street and the Birch Run Townhouse development that is diagonally across Seward Street to the northwest. With regard to the proposed three (3) single family homes on Van Dorn Street, initially this Project would eliminate the twice a day traffic that would be associated with the Day Care Center also the proposed uses are permitted and the lot size is consistent with the Van Dorn neighborhood. Attached at Exhibit"I" is a plan showing the tax parcels on the east and west sides of Van Dani Street extending north from Church Street. This is a combination of portions of three tax maps: 165.50, 165.42 and 165.34. We also attached a chart Exhibit"J" showing the thirty-six (36) tax parcels abutting Van Dorn Street along with their acreage, frontage and use. It is our position that these lots define the Van.Dorn neighborhood. Of these thirty-six (36) parcels, (19) lots or 52.7% have less frontage than the proposed lots and (18) lots or 50% have less acreage than the proposed lots. These new residential lots will be in the middle of the actual physical configuration of parcels that are within this neighborhood of the City. Also, directly across Van Dorn Street is Tax Parcel 165.39-1-12 which is owned by Woodlawn Apartment Inc. and is part of the larger area of acreage that is to the east of this tax parcel upon which the Wesley and Embury complex is built and expanding. We have had a conversation with representatives of Woodlawn Apartments and the other entities that are within the Campus and they have no long range or short-range plans to develop the Tax Parcels across the street from the new lots (Tax Parcel 12). As a result, allowing the introduction of the proposed three(3) single family residential lots, without comparable requested usage across the street, will not foster an overly densely developed dead end on Van Dorn Street. It will also drastically reduce the traffic flow and congestion at the northern dead end of Van Dorn Street which, with an operating Day Care Center, has no choice but to pass through the entire neighborhood twice a day on a five day a week basis. It is our position that this proposal is a significantly better utilization of these Tax Parcels than that which exists and could be continued. These represent three (3) independent residential structures on the property. 5) Also, there is a building that has historically been utilized as daycare/nursery school facility located on the southern boundary of the Property facing Van Dorn Street. 6) Attached as Exhibit "D" is a marked up copy of the above specified Survey showing the four(4) structures that are on the Property and their primary uses. 7) With regard to the three (3) residential structures, they appear to have been in existence for an extended period of time and continue to be functional residential properties. 8) I am attached the affidavit of attorney John J.
