NOTICE OF DECISION
In the matter of the application - #2018I055/18.057
Ballston Avenue Townhouses
96-110 Ballston Avenue
Saratoga Springs, NY 12866
Involving the premises with tax parcel nos. 178.26-I-39, 40, 46 in the City of Saratoga Springs, on an application
for site plan for 18 multi-family residential units in the Transect-5 Neighborhood Center District.
In accordance with 6 NYCRR Part 617, the Planning Board classified this request as an Unlisted Action.
Issued a Negative SEQRA Declaration on January 10, 2019
And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance, chapter
240, article 7.2 "Site Plan Review",the Planning Board issues the following decision on January 16, 2020 (passed
7-0 in favor: Torpey, Totino, Horton, Fabozzi, Boivin, Bonitatibus, Mayo):
Approve with the following conditions:
I. Side elevation of the buildings facing Finley St.to have sufficient openings and additional architectural
details that present to pedestrians as more of a"front"than a"side" of the building.
Note: DRC Architectural Review required.
2. Installation of a CDTA bus shelter and two benches to satisfy the civic space requirement.
3. Final plans shall be provided to the satisfaction of the City's designated engineer and DPW, including
resolution of ownership of the utilities.
4. A signage plan that will promote safe and efficient traffic movements as well as respectful of the
architectural design of the project shall be provided and be to the satisfaction of DPS.
5. Landscaping along Ballston Ave., Finley St., and the unimproved alley shall be to the satisfaction of the
City Arborist.
6. Language within the Homeowner's Association declaration of covenants shall be to the satisfaction of
the City Attorney.
7. If City Council grants an easement along the existing unimproved alley for placement of streetscape
improvements then the licensing agreement between the City and HOA shall be to the satisfaction of
the City Attorney.
8. Filing of ingress/egress easement to adjoining neighboring property to the North (Dorr property).
The applicant is required to:
I. Deliver a letter of credit or cash escrow in the amount approved by DPW to the City per Article 7.2.15 of
the Zoning Ordinance. This must occur prior to final signature by the Planning Board Chair.

2. Submit a fee in lieu of recreational lands of$2,000 for each new residential unit per Article 7.2.18 of the
Zoning Ordinance.
3. Submit one (I) mylar and two (2) paper copies of the final approved site plans for signature by the Planning
Board Chair within eighteen (18) months of approval as per Article 7.2.12 of the Zoning Ordinance.
Note: this approval shall expire within eighteen (18) months of the signature of final plans if the applicant has not
started actual construction as per Article 7.2.14 of the Zoning Ordinance.
