Ayes all. 99.04 EBERLEIN PROPERTY: 30-50 Ruggles Road This is a public hearing on an application for a 2-lot subdivision in a RR-1 district. Dan Wheeler,surveyor, appeared before the Board representing Matt Eberlein. Dan Wheeler addressed the following policy issues as listed in the Board's agenda notes: Background/History: The applicant recently purchased the lot and was denied a building permit because the lot was apparently subdivided in 1973 without benefit of a subdivision approval from the City. The City's subdivision regulations were enacted in 1991. It would appear that the original 1971 property consisted of both lot #1 (applicant's) and lot #2 (Raga, VanAlstyne and Jacobs property). The applicant is only seeking to "legitimize" his tot and not the other three lots. Proposed lot configuration: This 10-acre parcel (lot #1) could be further subdivided in the future. If this were ever to be done, Dan Wheeler said the applicant is aware that the City might want a road and/or rights to access adjacent lands. Geoff Bomemann noted that the proposed house location required a 500-foot driveway that is expensive to maintain and may cause problems for emergency services, The Board noted that this lot has plenty of road frontage and the house location on the lot is the applicant's decision and not the Board's. Ruggles Road condition: Dan Wheeler said they do not want to make improvements to Ruggles Road,which is considered substandard. The Board agreed that the applicant should not have to make such improvements. Topography:The Board agreed to waive the topography requirement since it was a large site and it had no unusual features. Waivers: At the applicant's request, the Board agreed to waive curbs, sidewalks and street trees because of the low density of the lot. efe- Recreation land or cash in-lieu-of land: Dan Wheeler asked if the applicant would be required to pay a recreation fee since this already was an established lot. The Board said the fee must be paid unless land is donated. Dan Wheeler agreed to pay the fee. Driveway culvert: Dan Wheeler said they do not want to. put in a culvert because the topography near the driveway did not require a culvert.The Board agreed. Letter of credit: The Board waived the cost for letter of credit because all improvements within the public ROW are less than$10,000. Dan Wheeler agreed to comply with all the technical issues as listed in the Board's agenda notes. Norman Fox said this is subject to a public hearing and asked for comments from the audience and noted a letter received from Gary and Leeanne Raga, 50 Ruggles Road. No one spoke. Eleanor Mullaney asked about the letter received from the neighbor. Geoff Bornemann said the neighbor might have misunderstood the application because the letter was in opposition to the granting of any zoning variance. He said the applicant is in compliance. He said there is no variance being requested. Norman Fox noted the following comments from the departments: DPS comments: "No concerns or comments." DPW comments: "No concerns or comments." Saratoga County Planning Board comments:Pending Norman Fox noted that any approval would be contingent upon a favorable advisory opinion from the County Planning Board.
