In accordance with 6 NYCRR Part 617, the Planning Board classified the action as Unlisted and issued a Negative SEQRA Declaration on March 26, 2026 passed 5-0 in favor: Pingel, Mayo, King, Stellato, White; And, in accordance with Site Plan Review approval standards in the Unified Development Ordinance, Article 13.5, the Planning Board issued the following decision on August 13, 2026 passed 5-0 in favor: Pingel, McTygue, King, White, Trifilo:  Approve site plan set with revision date 7/21/26 with the following revisions and conditions: 1. Applicant shall add a note to the final site plan set providing for a cross-access easement allowing for a potential, future, vehicular connection from the subject property to the property to the north (19 West Ave.). 2. Final determination of the location of the cross-access connection shall be at the discretion of DPW in consultation with the Planning Department . 3. Applicant shall file a site plan map with cross-access easement note at the Saratoga County Clerk’s Office and provide verification of filing to the Planning Department. 4. Applicant shall show EV chargers on the site plan, either 6 spaces to be “EV Ready” or 3 spaces to be “EVSE-Installed.” 5. The dumpster enclosure shall be screened with a fence and landscaping to mitigate visual impacts. 6. Applicant shall install permanent signage along the DEC wetland buffer/conservation area consistent with the Planning Board’s no-cut buffer policy. 7. Applicant shall provide a fee-in-lieu of dedication of recreation lands per residential unit ($152,000). The Planning Board recommends that these funds be used toward development of the Station Lane park plan as guided by the Recreation Department. 8. Applicant shall seek a license from the City Council for the civic space improvements within the ROW. 9. Applicant shall coordinate with the Arts Commission and City Planning staff on possible public art installation within the public civic space area. 10. The final plans shall be to the satisfaction of the City Engineer/DPW. 11. Applicant shall coordinate with DPS on installation of the traffic control devices to allow pedestrian crossing on West Ave. The applicant is required to: 1. Provide documentation of conformance with all required conditions of approval. 2. Submit a fee in lieu of dedication of recreation lands for seventy-six (76) new residential units ($152,000). 3. Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to the City. This must occur prior to final signature by the Planning Board Chair. 4. Submit two (2) paper copies and one (1) electronic copy of the final approved site plan set for signature by the Planning Board Chair within eighteen (18) months of approval as per Article 13.5 of the Unified Development Ordinance. Note: this approval shall expire within eighteen (18) months of the signature of final plans if the applicant has not started actual construction as per Article 13.5 of the UDO.
