Barden, AICP, Administrator Office of Planning & Economic Development City of Saratoga Springs 474 Broadway Saratoga Springs, NY 12866 August 12, 2026 Re: Land Disturbance Permit for Nos. 543 & 545 Cresent Avenue City of Saratoga Springs, NY Dear Ms. Barden, This letter is to acknowledge receipt of the site findings and follow up visit report prepared by the City Engineer's Office dated August 10, 2026. Our office is in the process of preparing a SWPPP plan and site restoration plan in response to tree cutting activity on the above referenced properties for review and approval by the involved City Departments. In the interim, additional silt fences will be installed at both the top and toe slopes to protect soil erosion from entering Lake Lonely. Performance of this work has been permitted by Mr. Julian Fonseca, Code Enforcement Officer, as not being in violation of the preset Stop Work Order for the properties. In March 2026, a wetland delineation was performed on the two properties and field reviewed by Ms. Renee Perrotte, a wetland biologist at NYDEC Region 5 office. The wetlands, which are principally located along the shoreline of Lake Lonely, were determined to be non -jurisdictional wetlands. A letter of this documentation is enclosed for your information. No further involvement of DEC is anticipated for these two properties. We thank the planning board for their project concerns and we are proceeding to prepare the required work exhibits relative to slope gradients and restoration. Thank you for your assistance. Please note that wetlands or wetland adjacent areas within the parcel boundaries that are not currently jurisdictional may become jurisdictional in the future consistent with ECL Article 24. Pursuant to ECL section 24-0703, this determination shall be a complete defense to the enforcement of ECL Article 24 as to this parcel for a period of five years (through 10/21/2030). This determination pertains only to state -regulated freshwater wetlands and regulated adjacent areas. DEC also regulates protected streams, tidal wetlands, coastal erosion hazard areas, and other important environmental resources. Work affecting those areas may also require DEC permits.
