Upon approval of the two -lot subdivision, the applicant requested reconsideration of the
requirement to install the right-of-way street lights and street trees required by the City's UDO.
The applicant stated that, due to the proposed Excelsior Spring Avenue Connector Project, the
final location of the future sidewalk has not yet been determined.
After review of the applicant's request, the City has determined the following:
• As stated in the Notice of Decision dated September 25, 2025, the approved fee in lieu
of sidewalk construction along Excelsior Spring Avenue shall remain in effect. The
applicant is not required to show the sidewalk on the Final Check Set. The City will
determine the final sidewalk location as part of the future Excelsior Spring Avenue
Connector Project.
• The applicant may request a fee in lieu of the required right-of-way street lights,
subject to administrative approval by the Planning Department, if applicable.
• The applicant shall install all proposed right-of-way street trees shown on the site plan
approved by the Planning Board on September 25, 2025.
