Regional Director January 2, 2024 The Honorable John Safford Mayor, City of Saratoga Springs 474 Broadway Saratoga Springs, NY 12866 Re: WEIGHT RESTRICTION VAN DAM STREET Dear Mayor Safford: Recently, the New York State Department of Transportation (NYSDOT) received a complaint from the NYS Motor Truck Association regarding a posted weight restriction on Van Dam Street in the city. Upon further investigation, we found Weight Limit 5 Tons signs posted on Van Dam Street. Please note, Van Dam Street is listed as an access highway between Route 50 and Church Street in the Official Description of Designated Qualifying and Access Highways in New York (https://www.dot.ny.gov/divisions/operating/oom/transportation- systems/repository/Truck%20Book%202022.pdf). This listing was established by NYSDOT in 1993 following the criteria established by the Federal Highway Administration (23 CFR 658). Included in the federal regulations, are criteria that the NYSDOT may consider for the de -designation as an access highway. However, we are not aware of any of the conditions on Van Dam Street, at this time, that would warrant the de -designation. We do not believe the city's 5-ton weight limit may supersede the federal regulations and respectfully request weight limit signs be removed from the section of Van Dam Street designated as an access highway.
