For the Zoning Board to grant a request for a use variance, an applicant must prove that the zoning regulations create an unnecessary
hardship in relation to that property. In seeking a use variance, New York State law requires an applicant to prove all four of the following

character of the neighborhood for the following reasons:

Requesting reduced side set back to allow garage to line up with exsiting driveway allowing cars to go stright into the garage.
To grant an area variance, the ZBA must balance the benefits to the applicant and the health, safety, and welfare of the neighborhood and
community, taking into consideration the following:
1. Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance have
been explored (alternative designs, attempts to purchase land, etc.) and why they are not feasible.
Moving the Garage over to allow the 5' set back it would make it difficult to enter the garage and the driveway and fenceing would
need to be altered creating a financial burden
2. Whether granting the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby
properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood
character for the following reasons:
The Garage will be set back apporx. 90' from the road and 15' from the house. It will have vinyl siding and a shingled roof to
match the house.The right side of the property has a 6' vinyl fence and there are large bushes on the adjoining property creating a
natural site barrier.

The variance request is only for 18' to allow stright accsess from the exsiting driveway

The Garage will be set back 90' from the street and shouldl have no adverse affects on the neighborhood

Its just how the driveway was installed allowiing two cars to be parked side by side
