NOTICE OF DECISION
IN THE MATTER OF THE
APPLICATION #20260316 OF

Involving the premises at 216 West Ave., with Tax Parcel ID# 178.25-2-1, in the City of Saratoga Springs, on an
application for:
Special Use Permit for a neighborhood commercial establishment in the Urban Residential — 2 (UR-2) District;
and,
With the Planning Board who met on the application on June 18, 2026; and,
Held a public hearing for the Special Use Permit application for the proposed use on June 18, 2026, which
opened and closed on June 18, 2026; and,
In accordance with 6 NYCRR Part 617, the Planning Board classified the action as Type II;
(18) reuse of a residential or commercial structure, or of a structure containing mixed residential and
commercial uses, where the residential or commercial use is a permitted use under the applicable zoning
law or ordinance, including permitted by special use permit;
And, in accordance with the approval standards set forth in the City's Unified Development Ordinance, Article
13.4 "Special Use", the Planning Board issues the following decision on June 18, 2026 (passed 6-0 — in favor:
Pingel, Ferrante, Mayo, McTygue, Stellato, King):
0 Approve special use permit as submitted with the following condition:
• Add one tree along the West Ave. street frontage
Approval of the special use permit expires within 18-months of the date of approval if a building permit has not been
issued or the approval is extended, per 13.4 of the UDO.
