Saratoga Springs, New York 12866
From the determination of the Building Inspector involving the premises at 115 York Avenue in the City of
Saratoga Springs, NY being tax parcel number #166.45-2-36 on the Assessment Map of said City.
The Applicant having applied for an area variance for the construction of a new front porch and rear addition
that will include a second-floor master bedroom and bathroom, as well as, a single-story family room to a
single-family residence in the Urban Residential -3 District. Public notice having been duly give of a hearing on
said application on May 4 and May 18,2026.
In consideration of the balance between the benefit to the Applicant with the detriment to the health, safety and
welfare of the community, I move that the following variance for the following amount of relief:

1. Achievability by Other Means. The applicant has demonstrated that the lot is undersized and the
benefit of the proposed Improvement cannot be achieved by other means feasible to the Applicant.
There are no other adjacent properties available for sale.
2. Undesirable Change. The Applicant has demonstrated that granting this variance will not create an
undesirable change in the neighborhood character and has provided supporting comparable properties in
the neighborhood that have similar characteristics to the relief requested.
3. Substantiality. The requested variances are considered to be substantial, but are mitigated by the the
property being undersized and above factors.
4. Adverse Effect or Impact. The Applicant has demonstrated that granting this variance will not have
an adverse physical or environmental effect on the neighborhood. District permeability will be met.

5. Self-Created Difficulty. The request for the relief is self-created hardship as the Applicant desires to
construct a new front porch and rear addition, but that is not necessarily fatal to the Application.

NAYS: 0
This variance shall expire 18 months following the filing date of such decision unless the necessary
building permit has been issued and actual construction begun as per the Unified Development
Ordinance.
I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning
Board of Appeals of the City of Saratoga Springs on the date above mentioned, four members of the Board
being present.
