It "was" a real upgrade to the community. The reason I say "was" is because they have built a 12' wall around their property which now looks like a compound. With no respect for the zoning code nor building code of the City nor the residents of the neighborhood, the applicant has constructed 2 fences around their property and quite frankly have isolated and neglected their property from the VanDam side of the premises. One only has to look at the condition of the sidewalk with missing and raised brick from the herringbone designed walkway which is now dangerous to walk on and no longer safe for wheelchair transportation. This Board has the job to determine whether the construction of the wall/fence is a detriment to the health, welfare or safety of the neighborhood. Certainly it is a detriment. Let's just imagine for a moment that this "buffer" is allowed to stay because it allows for decibel reduction from truck traffic through the neighborhood. Although each application to the ZBA is handled independently, you certainly would have a difficult time rejecting future walled fortresses from being built up and down VanDam. Who is to say their backyard is more valuable than another homeowner's front or side yard on that street? How about the side streets? Would future applicants on Clinton, State, Woodlawn, Russell, Lawrence, and Wells be entitled to some noise reduction? Would everyone build their walls first and then flood the ZBA with applications from law firms demanding relief from noise from truck traffic?
