Mr. and Mrs. Stellato,
As you are aware, a central issue with regard to your current application before the Zoning Board of
Appeals involving the subject property has been the legality of the existing carriage house / garage facing
Long Alley at the rear of the property. Previous determinations from this department have established that
the structure itself is considered legally preexisting, nonconforming within the UR-3 zoning district in
accordance with the City's Zoning Ordinance, Section 240-5.4 but have called into question the legality of
the use as a second principal dwelling.
Based on the information presented as a result of your extensive investigation, my own investigation, and
my inspection of 1/3/20, I have come to the conclusion that there is sufficient evidence to reverse those prior
determinations. It is now my determination that the structure and the use as a dwelling ( 1St floor garage, 2nd
floor apartment) both legally existed prior to the effective date of comprehensive zoning in 1961 . As such,
both the use and the structure may continue under the provisions of Section 240-5. The main house and the
carriage house should both be considered principal structures for purposes of the district area and bulk
requirements. The principal coverage amount would be cumulative between the two structures.
Based on my inspection, the exterior stairs to the apartment are not code compliant and must be replaced.
The roof over those stairs must also be reinforced or replaced. Smoke and CO alarms must be updated
throughout the apartment. These items must be completed before the Building Department can authorize
occupancy of the apartment and need to remain as part of the planned project scope under consideration by
the Zoning Board of Appeals. If the variances are not granted, these changes would still be required within
the extent of the existing dimensions. Please let me know if I can be of further assistance.
