Home My WebLink About20260344 832 North Broadway Area Variance Intermunicipal Agreement between City of Saratoga Springs and the Town of Greenfield 06.01.2026AN INTERMUNICIPAL AGREEMENT BETWEEN THE CITY OF SARATOGA SPRINGS, NY AND THE TOWN OF GREENFIELD, NY Relative to the regulation of a certain parcel of land located partially in the City of Saratoga Springs and partially in the Town of Greenfield In accordance with General Municipal Law Section 119-U WHEREAS, The City of Saratoga Springs and the Town of Greenfield have from time to time over the years entered into intermunicipal agreements in furtherance of public benefit and public convenience; and WHEREAS, currently there exists a parcel of residential real property which is located partially in the City of Saratoga Springs and partially in the Town of Greenfield, which is designated as Parcel 152.84-1-3 on the Assessor's Map of the City of Saratoga Springs, and as Parcel 153.77-1-4 on the Assessor's Map of the Town of Greenfield, which is commonly known as 832 North Broadway and is more particularly described in Schedule A hereto; and WHEREAS, the Town of Greenfield and the City of Saratoga Springs both recognize that the establishment of uniform municipal land use regulation for the entire property is important to the orderly and reasonable use of the property, and will serve a public benefit; and NOW, THEREFORE, BE IT AGREED by and between the Town of Greenfield and the City of Saratoga Springs, that the following types of laws, riles and regulations relative to the use of the said property shall be administered and enforced according to the enactments in effect in the City of Saratoga Springs for both the portion of the parcel located in Saratoga Springs and the portion located in the Town of Greenfield: 1. All land use and zoning laws, rules, standards and regulations enacted by the City of Saratoga Springs as part of its Unified Development Ordinance (UDO) 2. All laws, rules, standards and regulations enacted by the State of New York as part of the NYS Uniform Fire Prevention and Building Code and the NYS Energy Conservation Construction Code, as amended. AND BE IT FURTHER AGREED, that the authority of the City of Saratoga Springs to act with respect to the aforementioned laws rules, standards and regulations shall extend to both the portion of the parcel located in Saratoga Springs and the portion located in the Town of Greenfield, just as if the entire parcel was located in the City of Saratoga Springs, AND BE IT FURTHER AGREED, that nothing in this agreement shall be construed as limiting or changing the respective taxing authorities of the City of Saratoga Springs and the Town of Greenfield with respect to the portion of the property within their respective boundaries, or as limiting or changing any municipal authority or boundary of either the City of Saratoga Springs or the Town of Greenfield other than as specifically agreed herein, AND BE IT FURTHER AGREED, that the inclusion of the current owners of the subject entire parcel as signatories to this agreement is only to document their acknowledgment and understanding of its terms, and not to imply that their consent is required to carry out all or any part of this agreement, AND BE IT FURTHER AGREED, The City of Saratoga Springs shall immediately inform the Town of Greenfield of any land use and/or development approval sought for this property including without limitation any Site Plan Review, Special Use, Use Variance, Area Variance, Boundary Line Adjustment and/or Building Permit Application(s) submitted to the City Planning Board, City Zoning Board of Appeals, City Design Review Board and/or the City Building and/or Community Development Department(s), AND BE IT FURTHER AGREED, that the benefits and provisions of this agreement shall inure to the benefit of the current owner of the subject entire parcel, its successors and assigns. AND BE IT FURTHER AGREED, that this Intermunicipal Agreement may be filed in the Office of the Saratoga County Clerk in the same manner as a deed of transfer. NOW, THEREFORE, the City of Saratoga Springs and the Town of Greenfield have entered into this agreement effective on the date signed by both parties hereto.
