IN THE MATTER OF THE APPEAL OF
Kate Amello
145 Union Avenue
Saratoga Springs NY 12866
From the determination of the Building Inspector involving the premises at 145 Union Avenue in the city
of Saratoga Springs, New York being tax parcel number 166.69-3-17 on the assessment map of said City.
The applicant having applied for an area variance under the UDO of said City to permit the demolition of
a existing garage in poor condition and to construct a new garage with a 2nd dwelling unit on the 2nd floor, located
in the Urban Residential-4 District
And, public notice having been duly given of a hearing on said application between April 20th through
May 18, 2026. In consideration of the balance between benefit to then applicants with detriment to the health,
safety and welfare of the community, I move that the following area variances for the following amounts of relief:
TYPE OF REQUIREMENT DISTRICT
DIMENSIONAL
REQUIREMENT
PROPOSED RELIEF REQUESTED
MAX. COMBINED COVERAGE % 40% 47.4% 7.4%
REAR SETBACK (2ND DWELLING) 25 FT 5 FT 20 FT
INTERIOR SIDE SETBACK (2ND DWELLING) 5 FT 1 FT 4 FT
MIN. LOT SIZE 3,000 SF/DU 6,000 SF 5,600 SF 400 SF
MIN. LOT WIDTH (2F) 80 FT 40 FT 40 FT
MAX. DRIVEWAY WIDTH (ALLEY) 10 FT (25%) 33.5 FT
(83.75%)
FROM 10 FT TO 33.5 FT
CURB CUT
As per the submitted plans or lesser dimensions, be approved for the following reasons:
1. Achievability by Other Means: The Applicant has demonstrated that this benefit cannot be achieved
by other means feasible to the applicant. The applicant would like to construct a detached garage. The
applicant submits that there is no other land available for purchase.
2. Undesirable Change: The Applicant has demonstrated that granting this variance would not produce
an undesirable change in neighborhood character or a detriment to nearby properties. The Board finds
that the applicant has demonstrated that the requested variance aligns with other properties in the
neighborhood.

3. Substantiality: The board finds that the variance requested is substantial, but notes the character of
the neighborhood mitigates this concern as the proposal is similar to other neighboring properties.
4. Adverse Effect or Impact: The board finds that this variance would not have a significant adverse
physical effect or environmental effect on the neighborhood or district. This property will adhere to
the standard district permeability requirements.
5. Self-Created Difficulty: The alleged difficulty is considered self-created insofar as the applicant
desires to construct a detached garage, however this is not necessarily fatal to the application.
Dated: May 18, 2026
Passes by the following vote:
AYES: 4 (G. Simpson, O. Maxwell, A. Demma, S. Harrigan)
NAYS: 0
This variance shall expire 18 months following the filing date of such decision unless the necessary
building permit has been issued and actual construction begun as per the Unified Development
Ordinance.
I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning
Board of Appeals of the City of Saratoga Springs on the date above mentioned, four members of the Board
being present.
