Presently and historically there exists on the Property three (3) residential units and a Nursery School/Day Care Center structure. I am submitting our client's check made payable to the Commissioner of Finance in the amount of$700 seeking an interpretation from the Zoning Board and/or an Area Variance pertaining to the use and utilization of this Property. With regard to the interpretation, I am submitting an Affidavit of attorney John McMahon who has personal knowledge as to the use and utilization of the Property and specifies that the three (3) existing resideental uses and the commercial Nursery School existed on the Property in the late 1950's and into the 1960's. My client's intention is to have the Property subdivided so that the present Nursery School building would be on a parcel fronting on Van Dorn Street. The Property is presently designated as City of Saratoga Spcings Tax Parcel No. 165.34-1-9 and is bounded on its east by Van Dorn Street and on its west by Seward Street. Presently and historically there exists on the general northwesterly corner of the property, a single family residence. To that structure's immediate northeast is a detached garage with a residential apartment above the garage. Attached to the garage and extending to the south is a residential bungalow. Finally, along the southerly botmdary of the property is a building that has been used for close to 60 years as a Nursery School/Day Care Center. Exhibit"A". Attached as Exhibit"B" is the Affidavit of John L. McMahon, who has pcacticed law in the City of Saratoga Springs since 1956. He and his wife, in 1957 and 1958, resided in the Bungalo�v on the Property and he knew the people who resided in the single family residence and the garage apa►-tment during that time frame. He also represented the Property owner in 1971. In his affidavit he described the three residential units on the Property and the Day Care/Nurseiy School use of the Property prior to I 960 and subsequent to that date. Attached as Exhibit"C" is the Affidavit of Steven J. Sbardella, who is the Managing Member of Top Dog Enterprises LLC, who acquired the Properiy from Rose Tate on may 21, 2019 and who swears that the configuration and potential usage of the Property is exactly the same in 2019 as described in the John McMahon Affidavit. It is the Applicant's contention based on these Affidavits that the placement and usage of the structures on the Property extends backwards continuously beyond 1960 thus making those uses and the placement of these structures pre-existin;, non-conforming uses under the Zoning Codes of the City of Saratoga Springs. That the historic permissive use of 46-46A Seward Street, Saratoga Springs, is for three (3)residential units and a detached comme►•cial Nursery School/Day Care. The Applicant is seeking a subdivision of the property into a Lot fronting on Seward Sh�eet(Lot I). This lot shall be 12,500 square feet which is the required lot size in the UR-1 Zone in which the prope�ty is located. As a concession to the density of the use on the Property, the Bungalow that is attached to the free standing garage will be discontinued and torn down. On Lot 2, facing Van Dorn Street, that measures 11,469 square feet, the pre-existing non-conforming Nursery School/Day Care Center will be discontinued and the building will be converted into a single family residence. As a result, presently there exists three(3) residential Units and a commercial Nursery SchooUDay Cace Center on the parcel and if it is allowed to be subdivided, the entire parcel will have a reduce density with only three (3) single family residential uses. Attached as Exhibit "D" is a list of the Tax Parcels that are north of Church Stceet, east of Seward,on both sides of Van Dorn bounded on the north by the Applicant's Property. There are 49 individual lots. The Applicant's Lot 1 complies with the size requirement in this Zone. Lot 2 on Van Dorn Street is 1 1,469 square feet or .263 of an acre. Of the 49 lots on the list, 34 are smaller than Lot 2 or 69.38°/o of the Lots. Also 8 Lots are listed as having two (2) residential units. The Planned reconfiguration of this parcel will not generate any more residential imits than alre�dy eYist and will eliminate the commercial traffic that the Day Care/Nursery School generated at the dead end of Van Dorn Street.
