Resolution Introducing a Proposed Local Law Amending the Unified Development
Ordinance of the City of Saratoga Springs
BE IT RESOLVED, by the City Council of the City of Saratoga Springs, New York, as follows:
WHEREAS, the City Council has the authority to amend the Unified Development Ordinance
pursuant to the Municipal Home Rule Law and the New York State General City Law; and
WHEREAS, the City Council has determined that certain provisions of the Unified
Development Ordinance should be amended to clarify and improve the administration of
land use board procedures and related provisions; and
WHEREAS, the proposed amendment includes revisions to multiple Articles of the Unified
Development Ordinance forthe purpose of improving consistency, clarity, and regulatory
administration; and
WHEREAS, the City Council intends to consider adoption of a local law amending the Unified
Development Ordinance; and
WHEREAS, the proposed amendment constitutes an action subject to review under the State
Environmental Quality Review Act; and
WHEREAS, prior to adoption of any such local law, the City Council must refer the proposed
amendment to the Planning Board pursuant to New York General City Law §27-a; and
WHEREAS, prior to adoption of any such local law, the City Council must refer the proposed
amendment to the Design Review Board pursuant to the UDO; and
WHEREAS, the proposed amendment may also require referral to the Saratoga County
Planning Board pursuant to General Municipal Law 5239-m; and
WHEREAS, the proposed amendment may also require referral to the New York State Historic
Preservation Office for review and comment in accordance with the requirements of the
Certified Local Government (CLG) Program administered by the New York State Office of
Parks, Recreation and Historic Preservation; and
WHEREAS, the City Council will hold a public hearing on the proposed local law in accordance
with applicable law.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Saratoga Springs
hereby introduces a proposed Local Law entitled:
"A Local LawAmending Certain Provisions of the Unified Development Ordinance of the
City of Saratoga Springs:'
and
BE IT FURTHER RESOLVED, that the City Council hereby declares its intent to serve as Lead
Agency for purposes of environmental review under SEQRA; and
BE IT FURTHER RESOLVED, that a copy of this resolution and the proposed local law shall be
referred by the City Clerk to the City Planning Board for advisory review pursuant to General
City Law §27-a; and
BE IT FURTHER RESOLVED, that a copy of this resolution and the proposed local law shall be
referred by the City Clerk to the Design Review Board for advisory review pursuant to the
UDO; and
BE IT FURTHER RESOLVED, that a copy of this resolution and the proposed local law shall be
referred bythe City Clerk to the Saratoga County Planning Board pursuantto General
Municipal Law §239-m; and
BE IT FURTHER RESOLVED, that a copy of this resolution and the proposed local law shall be
referred by the City Clerk to the New York State Historic Preservation Office for review and
comment in accordance with the requirements of the Certified Local Government (CLG)
Program administered bythe New York State Office of Parks, Recreation and Historic
Preservation.
BE IT FURTHER RESOLVED, that a public hearing on the proposed local law shall be scheduled
and noticed in accordance with applicable law.
