There is no documentation in the public record showing the decision on the use of parcel 165.83-1-23. I have written to Patrick Cogan, Zoning Officer, formally requesting the written documentation that defines the zoning and use determination regarding the proposed development on parcel 165.83-1-23. In accordance with City ordinance and zoning law, the City staff should have advised that the applicant needs to submit a ZBA application for a use variance in addition to the application that was submitted for the area variance. On January 12, 2026, the Zoning Board of Appeals granted an area variance related to parcel 165.83-1-22. That application and approval did not include a request for a use variance, nor did it address the zoning implications of the adjacent parcel, 165.83-1-23, which is being acquired for the project. I respectfully request that your office ensures that: • A formal zoning and use determination is issued for parcel 165.83-1-23. • Any required zoning relief is properly identified and pursued before further approvals or permits are issued; and • City staff applies the Unified Development Ordinance consistently and comprehensively to prevent piecemeal or incomplete review. I submit this letter so that the record clearly reflects this concern and so that appropriate corrective steps may be taken. Thank you for your attention to this matter. Respectfully, Patty Morrison
