NOTICE OF DECISION
In the matter of the application

Stewart’s Shops Corp.

Saratoga springs, NY 12866
Involving the premises with tax parcel no. 166.5-4-5 identified as 33 Marion Avenue in the City of Saratoga
Springs, on an application for site plan review of a 4,500 sq. ft. convenience store and gas pumps, 3,000 sq. ft.
commercial tenant space, and associated site work in the Tourist-Related Business (TRB) District.
In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA
Full Environmental Assessment Form Parts 1 and 2, the Planning Board issued a Negative SEQRA Declaration
on March 20, 2025;
And, in accordance with Site Plan Review approval standards in the Unified Development Ordinance, Article
13.5, the Planning Board issued the following decision on March 26, 2026 passed 5-0 in favor: Pingel, Mayo,
King, Stellato, White:
Approve site plan set (with revision date March 23, 2026) subject to the following revisions and conditions:
1.Applicant shall construct a sidewalk along the east side of Marion Ave. from the southern end of the
Adirondack Bank Kiosk property to the northern boundary of the Stewart’s property.
2.Pedestrian street lights (per City standard detail) shall be installed along the development frontage
(subject to NYSDOT approval).
3.A screen wall with clapboard siding shall be installed between the convenience store and the commercial
tenant building facing Marion Ave. to hide mechanicals located between the two buildings. An access
gate matching the screen wall façade shall be installed on the eastern side of the privacy wall.
4.Dumpster enclosure shall be hidden with sided fence made of natural materials to match the materials
used for the screen wall hiding mechanical systems between the commercial buildings.
5.A 4-foot high, black, chain-link fence shall be installed between the development and the conservation
area.
6.Conservation easement language for the conserved area to the north of the development shall be
acceptable to City legal counsel and filed at the County.
7.Applicant shall install two pedestrian crossings on Maple Ave.; one at Maple Dell and one at Avenue A
(subject to NYSDOT approval). If DOT does not permit both of the pedestrian crossings, then the applicant
shall return for further review via administrative action.
8.Screen wall and fence materials subject to administrative action by the DRB.
9.Final plans subject to DPW approval.
Note: The applicant agreed to maintain the sidewalks that will be installed and to keep the conserved
area cleaned up.
The applicant is required to complete the following prior to signing of the final site plan set by the Planning Board
Chair:
• Provide documentation of conformance with all required conditions of approval.
• Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on- and off-
site improvements in the amount approved by the City Engineer.
• Submit two (2) paper copies and one (1) electronic copy of the final approved site plan set for signature
by the Planning Board Chair within eighteen (18) months of approval.
Approval of the site plan shall expire within eighteen (18) months of the signature of final plans if the applicant
has not started actual construction as per Article 13.5 of the UDO.
