Dear Kevin Franke:
Thank you for requesting the comments of the Office of Parks, Recreation and Historic
Preservation (OPRHP). We have reviewed the project in accordance with the New York State
Historic Preservation Act of 1980 (Section 14.09 of the New York Parks, Recreation and Historic
Preservation Law). These comments are those of the OPRHP and relate only to Historic/Cultural
resources. They do not include potential environmental impacts to New York State Parkland that
may be involved in or near your project.
Based upon this review, it is the opinion of OPRHP that no properties, including archaeological
and/or historic resources, listed in or eligible for the New York State and National Registers of
Historic Places will be impacted by this project.
If further correspondence is required regarding this project, please be sure to refer to the
OPRHP Project Review (PR) number noted above. If you have any questions, please contact
Julie Maresco at the following email address:

LETTER OF NO JURISDICTION – FRESHWATER WETLANDS
03/23/2026
Robert Fraser
40 Long Aly, Saratoga Springs, NY, 12866, USA
Sent via email to: rfraser@thelagroup.com
Re: DEC Freshwater Wetlands Parcel Jurisdictional Determination for Parcel
411501165.67-1-58, Saratoga County
Dear Robert Fraser,
Based on the parcel identified in your request, the New York State Department of
Environmental Conservation (DEC) has determined that there are no DEC
regulated freshwater wetlands and/or adjacent areas identified on the parcel
referenced above. Therefore, in accordance with Article 24 of the Environmental
Conservation Law (ECL) and 6 NYCRR Part 663, no freshwater wetlands permit is
required. Pursuant to ECL section 24-0703, this letter shall remain valid for a period
of five years from the date it is issued (through 03/21/2031).
Please note that the current jurisdictional acreage threshold of 12.4 acres will
decrease to 7.4 acres on January 1, 2028. Therefore, as of January 1, 2028,
additional wetland areas may become jurisdictional after the effective term of this
determination.
This determination pertains only to state-regulated, freshwater wetlands and
regulated adjacent areas. DEC also regulates protected streams, tidal wetlands,
coastal erosion hazard areas, and other important environmental resources. Work
affecting those areas may also require DEC permits. More information on other
DEC permit programs is available online at https://dec.ny.gov/regulatory/permits-
licenses/environmental-permits.
Please note that this letter does not relieve you of the responsibility of obtaining
any other necessary permits or approvals from other local, state, or federal
agencies.
If you have questions regarding this determination, please email
R5BEH@dec.ny.gov.
