Stewart's shop with six gas pumps under canopy along with a 3,000 s.f. separate commercial building that will be for lease on a 2.3-acre site currently used as a Mobil gas station and carwash. Location (Jurisdictional Determinant): Marion Ave./US Rte 9 (NYS Route 50, Town of Greenfield, Town of Wilton) Tax Map #: 166.5-4-5 Zoning: Still reviewed under previous zoning Tourist Related Business. UDO Zoning Change to GC-U. Received from the City of Saratoga Springs Planning Board on February 13, 2026. Reviewed by the Saratoga County Planning Board on March 19, 2026. Decision: No Significant County-wide or Intercommunity Impact Comments: When reviewed for area variances in March of 2024, the plan included a car wash and three variances. The required front yard setback was 40 ft, where 8 ft was proposed for the Stewart's Shop building (32 ft of relief) and 25 ft (15 ft of relief) for the gas canopy. Also, the relief for the rear yard setback for the canopy was requested as 10 ft is the minimum required with 0 ft proposed (10 ft of relief). Since, the site plan has changed, please review the variances and refer any missing variances that have not been submitted for GML-239m review. The NYSDOT commercial driveway/access permit and utility permits will be needed regarding the utility work and access improvements along US Route 9. As a reminder, GML-239nn requires proposed special use permits, use variances, site plans and subdivisions within 500 ft. of an adjacent municipality’s shared boundary (Town of Greenfield, Town of Wilton) to notify the neighboring clerk, by mail or electronic transmission, of the pending project at least 10 days prior to any hearing.
