The Stewart’s Shop Marion Ave expansion project 20250022 is on the agenda for the Planning Board
meeting March 26, 2026.
We, as adjacent neighbors at 11 Marion Avenue, have done our best to advocate for a smaller project
more fitting for our neighborhood; for the congested traffic area at the intersection of Rt 50, Marion
Avenue, and Maple Dell; and for the proximity to Lougherry Lake. We have seemingly exhausted our
options through the City Council, Planning Department and the Zoning Board of Appeals.
We are satisfied that there will be a conservation easement directly between our property and the
commercial enterprise. We do not speak for any other residents in our Neighborhood Association on
this point.
We appeal to the Planning Board to consider requiring an 8 foot stockade fence, (not a chain link fence)
along the northern boundary of the commercial property between the non-residential district, and
residential district abutting to the north, behind the proposed trash bins to assist in protecting the
environment of that conservation easement, and to ease noise. We also ask the Planning Board to
require a final clean up of the trash in that lot completed by Stewart’s Corp during or immediately after
their construction project,
For the following reasons:
1. The wooded lot north of the current car wash and UHaul parking lot which will be the
“conservation easement” has, over the past 2-4 years, been littered with a mattress, rugs, an
office chair, rubber mats, plastic chair, etc…Most of these are forever sorts of materials that do
not degrade as natural elements. Therefore, designating the property as a conservation
easement “as is” without some form of clean up is contrary to the intent of protection of wooded
areas and protection of the environment and providing a buffer between the commercial
businesses and the residential district.
2. We continue to be concerned that in future, paper, plastic, glass, and metal trash will
accumulate in the parking lots of the stores; be thrown by customers; or be blown by the wind
into the wooded area.
3. We are concerned that noise/light/trash pollution from the businesses will intrude upon our use
of our backyard.
