The applicant is requesting an area variance for a HVAC condenser and the interior
setback of an addition made in 2017. This request arises from an inaccurate plot plan
that was submitted for a building permit by the previous owner.
This application is hereby denied upon the grounds that such use of the property would violate the
Unified Development Ordinance article(s):
Article: The previous zoning ordinance of the subject address, was classified as Urban Residential
District UR-3, in effect from 2012 to 2022. This ordinance mandated a side setback of 4 feet,
contributing to a total side setback requirement of 12 feet.
As such, the following relief would be required to proceed:
