NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION

EXCELSIOR CANNABIS, LLC
75 WEIBEL AVENUE
SARATOGA SPRINGS, NY 12866
Involving the premises with tax parcel #153.-1-19 & 166.-2-2 & 30, in the City of Saratoga Springs, on an application for a
permanent special use permit for a marijuana dispensary in the Neighborhood Center (T-5) District.
In accordance with 6 NYCRR Part 617, the Planning Board classified the action as a Type II SEQRA Action:
• (18) reuse of a residential or commercial structure, or of a structure containing mixed residential and commercial
uses, where the residential or commercial use is a permitted use under the applicable zoning law or ordinance,
including permitted by special use permit;
And, upon evaluation of the application based on the City’s enumerated evaluation criteria to ensure that the proposed
use will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City’s Unified Development Ordinance, article 13.4
“Special Use”, the Planning Board issues the following decision on February 26, 2026 (passed 6-0 – in favor: Pingel,
Ferrante, Mayo, McTygue, Stellato, White):
Extend a temporary (120-day) special use permit for a marijuana dispensary (approximately 1,250 sq. ft.) within an
existing building with the following conditions:
Conditions:
1. The special use permit shall remain in effect for an additional 120-days from March 1, 2026 (second expiration
date). The new expiration date is July 1, 2026.
2. The site plan dated December 22, 2025 (approved with revisions and conditions) shall be further modified as
follows:
a. Relocate the dumpster enclosure to the new parking area adjacent to parking space E1.
b. Replace the vinyl trash enclosure fence detail with a wood fence detail.
c. Include plantings around the dumpster enclosure.
