NOW, THEREFORE BE IT RESOLVED that the Planning Board hereby makes the following findings,
determinations and certifications:
PB#13.031.4 Rip Van Dam Site Plan Modification Notice of Decision
I. The project is proposed within the City's Transect-6 District along Washington Street, a
highly traveled City street as well as the designated City truck route.
2. While no parking is required within the Transect-6 District, the evaluation of transportation
impacts directly caused by the project has been considered carefully in consideration of any
potential environmental impacts within the project's SEQRA review, and site plan review of
the project. No parking is located on the subject parcel, instead will be provided via the
proposed 5 deck parking structure on Hamilton Street.
3. As a result of the project,the following level of service drops will be experienced:
• Saturday peak hour at Washington Street/Broadway intersections
o Broadway northbound LOS B to LOS C
o Overall intersection LOS B to LOS C
• PM peak hour at Washington Street/Federal Street/Railroad Place intersection
o Washington Street westbound LOS B to LOS C
o Overall intersection LOS B to LOS C
The split phasing operation decreases the efficiency of this intersection and results
in a reduced overall capacity making this location sensitive to increases in traffic.
4. The Planning Board has determined that specific transportation mitigation will be required to
be provided to specifically mitigate the project's direct and cumulative impacts on
transportation.
5. After review of the Part I and Part 2 of the SEQR long Environmental Assessment Formand
consideration of proposed project changes, a SEQR negative declaration is affirmed for the
project.
THE PLANNING BOARD HEREBY GRANTS APPROVAL OF THE APPLICANT'S FINAL SITE PLAN
MODIFICATION PER THE REQUIREMENTS SET FORTH IN THE CITY OF SARATOGA SPRINGS
ZONING ORDINANCE AND SUBJECT TO THE FOLLOWING CONDITIONS:
1. A 30 ft. setback for the stop bar on Washington Street(eastbound)will be required to be
installed.All signage and conditions as noted within Public Safety comments of October 10,
2013 shall be fulfilled.
2. The existing Washington Street loading area will remain on the north side of the street, but be
relocated 25 ft.west of its current location-subject to City DPS approval.
3. One-way egress from the site will be right out only to discourage vehicles from turning left to
head east to Broadway,this requirement will be reinforced via physical bull nose curbing and
signage.
4. Applicant will work with CDTA and shall offer bus passes to employees of the hotel and
restaurant facility.This will be reflected in the hotel's enrollment with CDTA's Universal
Access program.
5. Applicant shall post web-based driving directions that direct drivers to the Hamilton Street
garage facility instead of the hotel.

Submit one(I) mylar and two (2) paper copies of the final approved site plans for
signature by the Planning Board Chair within eighteen (18) months of approval as per
Article 7.2.12 of the Zoning Ordinance.
This approval shall expire within eighteen (18) months of the signature of final plans if the applicant
has not started actual construction as per Article 7.2.14 of the zoning ordinance.

8 In accordance with SEQRA regulations made a motion to reaffirm the SEQRA
Negative Declaration of environmental significance issued on March 26,2014 after
finding no additional review required with reduction in hotel rooms proposed.
Approved site plan modification with the following conditions:
o The number of hotel rooms shall be reduced from 176 to 142 rooms,existing
floors within existing structures shall remain a mix of uses and no longer
contain hotel units.No exterior changes are proposed.
o All other conditions of original project approval issued on March 26, 2014
shall continue to be required.
The applicant is required to:
e Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to the
City per Article 7.2.15 of the City of Saratoga Springs Zoning Ordinance. This must occur
prior to final signature by the Planning Board Chair.

I. Banquet facility will offer events for a maximum of 200 people.This maximum occupancy will
also be reflected on the Fire Department issued certificate of occupancy.

installed.All signage and conditions as noted within Public Safety comments of October 10,
2013 shall be fulfilled.
3. The existing Washington Street loading area will remain on the north side of the street, but be
relocated between the project's two access points.
4. One-way egress from the site will be right out only to discourage vehicles from turning left to
head east to Broadway, this requirement will be reinforced via physical bull nose curbing and
signage.
5. To assist in providing a viable transportation alternative for hotel patrons to reach local
destinations and reduce individual car trips,the Applicant shall contribute$20,000 towards
increasing the time span and frequency of seasonal Capital District Transportation Authority
(CDTA)shuttle service, or towards overall pedestrian, bicyclist, and transit accommodations
within Saratoga Springs.

6. Applicant will work with CDTA and shall offer bus passes to employees of the hotel and
banquet facility.This will be reflected in the hotel's enrollment with CDTA's Universal Access
program.
7. Applicant shall post web-based driving directions that direct drivers to the Hamilton Street
garage facility instead of the hotel.
8. The Hamilton Street parking garage(Parcel ID#165.75-1-47.1, City PB#13.055),will serve
the parking needs of the hotel, banquet space and employees of the facilities. The garage is
required to continue to serve these uses in this capacity in order to retain its certificate of
occupancy.As a continuation of a past site plan approval condition, 40 spaces for Palio
employees shall be required to continue to be provided. Public parking may also be offered as
capacity allows.
9. The Hamilton Street parking garage must receive its certificate of occupancy and be
operational prior to any certificate of occupancy being issued for this project.
10. Garbage collection shall be made along Washington Street with bins rolled out at time of
garbage truck pick up. Bins shall not remain along Washington Street frontage for any length
of time.
l I. The shared service driveway shall serve delivery needs of the hotel, banquet facility,
Maestro's, and the Adelphi Hotel.All delivery trucks 30' or under are required to utilize the
service driveway for on-site deliveries.All delivery vehicles using the service driveway shall
pull in and turn around in the loading dock area, no backing in or out of vehicles will take
place.
12. Utility lines shall be removed along the Washington Street frontage and utilities placed
underground.A required transformer shall be sited to the rear on adjacent property.The
executed easement is required to be provided to the Planning Department.
13. Storm sewer infrastructure(varies between 18", and (2) 12" pipes)shall be constructed
along Washington Street west of subject property boundary, and to the north along Broadway
and tie into existing public infrastructure as illustrated on the revised site plan.
14. The proposed streetscape improvements on Broadway as modified are approved by the
Planning Board, with final details subject to Planning Board Chair approval.All improvements
within the City Right-of-way are subject to DPW Commissioner approval.
15. Radiant sidewalks as proposed by the applicant along the Washington and Broadway frontage
shall be installed as shown on the revised site plan.
16. Final parking lease agreement between Rip Van Dam Hotel and the Hamilton Street garage
site must be approved by the City Attorney and/or Planning Board Attorney.
7. Remainder of escrow required for retention of Creighton Manning Engineering for services
to the City Planning Board shall be provided by the applicant.

18. Written agreement among the applicant,Adelphi Hotel,and Maestro's, assuring that
common vendor deliveries to both facilities will be coordinated so as to avoid duplicate
delivery trips to the same vendors to the maximum extent possible.
The applicant is required to:
• Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to
the City per Article 7.2.15 of the City of Saratoga Springs Zoning Ordinance. This must
occur prior to final signature by the Planning Board Chair.
• Submit one (I) mylar and two (2) paper copies of the final approved site plans for
signature by the Planning Board Chair within eighteen (18) months of approval as per
Article 7.2.12 of the Zoning Ordinance.
This approval shall expire within eighteen (18) months of the signature of final plans if the applicant
