With the Planning Board who met on the applications on May 8, 2025, May 22, 2025, July 31, 2025, November 20, 2025, December 4, 2025 and January 22, 2026; and, Sought an advisory opinion from the Design Review Board (DRB) specifically requesting input on mass, scale, height, compatibility with neighboring properties and the character of the neighborhood on May 22, 2025; and, Received a favorable advisory opinion from the DRB on June 11, 2025 – stating (in part) that the mass, scale and height are in proportion and not inappropriate; and the structure is not incompatible with the context of the neighborhood; and, In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA Short Environmental Assessment Form Parts 1 and 2, the Planning Board issued the following decision on January 22, 2026 passed 7-0 in favor: Pingel, Ferrante, Mayo, McTygue, King, Stellato, White:  Issue a Negative SEQRA Declaration And, in accordance with Site Plan Review approval standards in the Unified Development Ordinance, Article 13.5, the Planning Board issued the following decision on January 22, 2026 passed 7-0 in favor: Pingel, Ferrante, Mayo, McTygue, King, Stellato, White:  Approve site plan set (as revised January 22, 2025) subject to the following revisions and conditions: 1. The project shall use the exterior building materials as specified in memo from Frost Hurff Architects, dated January 19, 2026, except the first-floor railings shall be wood. 2. Implementation of tree replacement plan for removal of significant trees totaling 214” dbh with equivalent caliper of new trees to be planted off-site on City property with coordination of the City Arborist/DPW on tree species and locations. 3. Installation of decorative street lights shall be coordinated with DPW including removal of the existing, pole-mounted light fixture along the Park Place frontage. 4. The overall height of the retaining wall and fence shall not exceed 6-feet high and shall be updated on the detail sheet and the drawings. 5. The applicant shall submit proposed locations for a pad transformer, gas meters, and accessory structures for further review via administrative action by the Chair. 6. HVAC, meters, transformers, accessories structures, or any other similar addition to the building or property shall be appropriately screened by landscaping so as not to be visible from the streets or from the windows of the building. 7. Electrical service shall be provided to the building from a pole-mounted transformer with a line that runs underground from the pole. There will be no overhead wire connection to the building. 8. There shall be no mechanical equipment mounted on the roof. 9. Maintenance procedures for the landscaping and building grounds shall be documented in the HOA rules and covenants. 10. Implementation of the trash management plan as identified in the “trash removal intent” submitted by Studio A, dated July 30, 2025. 11. Trash containers shall be stored indoors, except on trash collection days. There will be no permanent dumpsters used to support building trash collection 12. The Board accepts the fee in lieu of dedication of recreation lands for each of the 6 residential units ($12,000). 13. Final plans shall be provided to the satisfaction of DPW. The applicant is required to complete the following prior to signing of the final site plan set by the Planning Board Chair: • Provide documentation of conformance with all required conditions of approval. • Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on- and off- site improvements in the amount approved by the City Engineer. • Submit a fee in lieu of dedication of recreation lands for six (6) new residential unit ($12,000). • Submit two (2) paper copies and one (1) electronic copy of the final approved site plan set for signature by the Planning Board Chair within eighteen (18) months of approval. Approval of the site plan shall expire within eighteen (18) months of the signature of final plans if the applicant has not started actual construction as per Article 13.5 of the UDO.
