NOTICE OF DECISION
IN THE MATTER OF THE
APPLICATION #20250202 OF
VINCENT AND KATHERINE LATERRA
7 COTTAGE STREET
SARATOGA SPRINGS, NY 12866
Involving the premises at 7 Cottage Street, with Tax Parcel ID# 165.84-1-4, in the City of Saratoga Springs, on an
application for final plat review of a proposed two-lot subdivision in the Urban Residential – 4 (UR-4) District;
and,
With the Planning Board who met on the application on May 8, 2025, May 22, 2025, July 31, 2025, November 20,
2025, December 4, 2025 and January 22, 2026; and,
Held a public hearing on May 8, 2025, which was kept open and continued until it was closed on November 20,
2025; and,
Extended the 62-day requirement to render a decision on the final plat (after close of the public hearing) on
January 15, 2026; and,
In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA
Short Environmental Assessment Form Parts 1 and 2, the Planning Board issued the following decision on
January 22, 2026 – passed 7-0 (Pingel, Ferrante, Mayo, McTygue, King, Stellato, White);
Issue Negative SEQRA Declaration
And, in accordance with the purpose and objectives set forth in the City’s Unified Development Ordinance Article
14 “Subdivision Approval”, the Planning Board issued the following decision on January 22, 2026 – passed 7-0
(Pingel, Ferrante, Mayo, McTygue, King, Stellato, White);
Approve final plat with the following revisions and conditions:
1. Implementation of tree replacement plan for removal of significant trees totaling 214” dbh
with equivalent caliper of new trees to be planted off-site on City property with coordination of
the City Arborist/DPW on tree species and locations.
2. Installation of decorative street lights shall be coordinated with DPW including removal of the
existing, pole-mounted light fixture along the Park Place frontage.
3. The Board accepts the fee in lieu of dedication of recreation lands for each of the 6 residential
units ($12,000).
4. Final plans shall be provided to the satisfaction of DPW.
The applicant is required to complete the following prior to signing of the final plat by the Planning Board Chair:
• Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on- and off-site
improvements.
• Submit a fee in lieu of dedication of recreation lands for the new residential units ($12,000).
• Submit one (1) mylar and two (2) paper copies of the final approved subdivision plat for signature by the
Planning Board Chair.
File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as provided in Article 3,
Section 32 of General City Law.
Approval of the final plat expires within one year after the resolution granting such approval unless all requirements
stated in such resolution have been certified and completed per Article 14 of the UDO.
