NOTICE OF DECISION
In the matter of the application
#20250022 33 Marion Ave. Stewart’s Demo & Construction - Construction
33 Marion Ave.
Saratoga Springs, New York 12866
involving Architectural review of construction of a self-serve fueling station, convenience store and tenant unit within
the GC-U District, tax parcel # 166.5-4-5, within the City of Saratoga Springs.
In accordance with 6 NYCRR Part 617, the Design Review Board classifies this request as a SEQR:
Unlisted Action- Negative Declaration by Planning Board March, 2025
And, in accordance with the objectives, standards and guidelines contained in the Unified Development Ordinance
Article 240-13.9 Architectural Review Applicability and Approval Standards, the Design Review Board issues the
following decision on February 11, 2026:
Approve the plans with the following conditions:
1. Use black chain link fencing around dumpster
2. Siding to be smooth
3. Base – whether brick or stone – to be continued around entire structure
4. Base details, caps & mortar to be submitted for administrative approval

Note: this approval shall expire 18 months from the issuance date unless any necessary building permit has been
issued and actual work begun.
