INSTRUCTIONS
APPEAL TO THE ZONING BOARD FOR AN
INTERPRETATION, USE VARIANCE, AREA VARIANCE AND/OR VARIANCE EXTENSION
APPLICATION REQUIREMENTS
1.ELIGIBILITY: To apply for relief from the City’s Zoning Ordinance, an applicant must be the property owner(s)
or lessee, or have an option to lease or purchase the property in question. The Zoning Board of Appeals (ZBA)
shall not accept any application for appeal that includes a parcel which has a written violation from the Zoning
and Building Inspector that is not the subject of the application.
2.COMPLETE SUBMISSIONS: Applicants are encouraged to work with City staff to ensure a complete application.
The ZBA will only consider properly completed applications that contain 1 original and 1 digital version of the
following:
Completed application pages 1 and 8, the pages relating to the requested relief (p. 2 for interpretation or
extension, pp. 3-5 for use variance, pp. 6-7 for area variance), and any additional supporting materials/
documentation. **HANDWRITTEN APPLICATIONS WILL NOT BE ACCEPTED**
Completed SEQR Environmental Assessment Form – short or long form as required by action.

Detailed “to scale” drawings of the proposed project – folded and no larger than 24”x 36”. Identify all
existing and proposed structures, lot boundaries and dimensions, and the relationship of structures to
the lot dimensions. Also, include any natural or manmade features that might affect your property (e.g.,
drains, ponds, easements, etc.).
Photographs showing the site and subject of your appeal, and its relationship to adjacent properties.

PUBLIC HEARING ADVERTISEMENT
The Zoning Board of Appeals is required to hold a public hearing on each submitted application within ninety (90)
days from when it is determined to be properly complete by City staff.
City staff will prepare a legal notice for the public hearing and arrange to have the public hearing
announcement printed in the legal notice section of a local publication at least 5 days before the hearing.
PROPERTY OWNER NOTIFICATION
Applicants are required to mail a copy of the public hearing legal notice to all property owners within the following
distances from the boundaries of the land in question:

This notice must be sent at least 7 days but not more than 20 days before the date of the public hearing.
City staff will email a copy of the “property owner notification letter” to the applicant. The applicant must then send
the notification letter to the nearby property owners. Applicants may not include any other materials in this mailing.
The mailing must be certified by the U.S. Post Office. Prior to the public hearing, applicants must present the Post
Office “certificates of mailing” to the ZBA. If “certificates of mailing” are not presented prior to the hearing, the
hearing will be cancelled.

GENERAL NOTES
1. Construction shall conform to the latest edition of the Residential
Code of New York State (RCNYS) and the Energy Conservation
Construction Code of New York State, with possible modification by
local code administration.
2. In the event of conflict between pertinent codes and regulations and
referenced standards of these drawings and specifications, the
more stringent provisions shall govern.
3. Contractor shall be responsible for all materials, construction
methods, craftsmanship, procedures and conditions (including
safety).
4. Contractor is responsible for stabilization of existing structure
during construction.
5. Contractor shall verify all existing conditions, requirements, notes,
and dimensions shown on Drawings or noted in Specifications. Any
variances within drawings and Specifications, or with conditions
encountered at job site, shall be reported in writing to Charette
Associate Architects, P.C. (CAA) before commencement of any work
affected by such variance.
6. Existing topographic site data is not available to the Architect.
Contractor shall field verify topographic data and adjust any
indicated vertical control dimensions as required. Final grading
shall pitch storm drainage away from any structures on the site.
7. Contractor shall rigidly adhere to all laws, codes, and ordinances,
which apply to this work. Contractor shall notify and receive written
clarification from CAA of any variations between contract
documents and governing regulations.
8. The Contractor shall make no structural changes without written
approval of CAA.
9. CAA has not been engaged for construction services and assumes
no responsibility for construction conformance, means, methods,
techniques or procedures of on-site work relating to the
construction plans. CAA assumes no responsibility for unauthorized
deviations from the drawings.
10. All manufactured materials, components, fasteners, assemblers, etc.,
shall be handled and installed in accordance with manufacturer's
instructions and provisions of applicable industry standards. Where
specific manufactured products are called for, generic equals that
meet applicable standards and specifications may be used.
11. All materials used to be selected and installed in accordance with
state, federal, national and local codes and installed in accordance
with manufacturers recommended installation procedures.
12. Construction loads shall not overload structure nor shall they be in
excess of design loadings indicated herein.
13. Drawings and specifications are intended to provide the basis for
the proper completion of the Project suitable for the intended use
of the Owner.
14. Items not expressly set forth but which are reasonably implied or
necessary for the proper performance of this work shall be
included.
15. Comply with applicable codes, regulations, ordinances and
requirements of authorities having jurisdiction. Submit copies of
inspection reports, notices and similar documents to Architect.
16. Provide products of acceptable manufacturers, which have been in
satisfactory use in similar service for three years. Use experienced
installers.
17. Furnish evidence of experience if requested.
18. Deliver, handle, and store materials in strict accordance with
manufacturer's instructions.
19. Inspect substrates and report unsatisfactory conditions in writing.
20. Do not proceed until unsatisfactory conditions have been
corrected.
21. Take field measurements prior to fabrication where practical. Form
to required shapes and sizes with true edges, lines and angles.
Provide inserts and templates as needed for work of other trades.

RIGHT-OF-WAY PERMIT POLICY
1. Commencement and Completion of Work
All permitted work shall commence within forty-eight (48) hours of the approved Estimated Start Date and shall be completed within forty-eight
(48) hours of the approved Estimated Completion Date. Any change to the approved start or completion dates shall require prior written
approval from the Department of Public Works (DPW).
2. Fees and lnspections
There is a MINIMUM CHARGE of $75.00 for the application plus an additional $370.00 ($460.00 for Broadway) for street to be opened. The
City Engineers Office will provide spot check inspections during work and may invoice you for these inspections in accordance with the
Commissioner of Finance fee schedule. No new permit will be issued until the previous permit has been paid for.
3. Utillty Locating Requirements
Prior to excavation, the permittee shall contact DIG SAFELY - New York (1-800-962-7962) not less than two (2) working days before
excavation begins, exclusive of the day of request, to identify underground utilities.
4. Daily Notification
The permittee shall notify the City Garage on the morning work is to be performed. Call the DPW Garage at 7:00 a.m.

5. Backfill, Compaction, and Temporary Patching
The permittee shall be responsible for furnishing clean backfill material and ensuring proper compaction of all excavated areas. lf settlement
occurs due to improper compaction, the City may perform corrective work and all associated costs shall be charged to the permittee. The utility
company shall maintain all temporary patches until final pavement restoration is complete. Temporary patches shall be inspected daily. The
City may charge for conective work if maintenance is inadequate.
6. Winter Restoration
During November through April, restoration of an emergency street opening is to be accomplished by placing clean fill and rubble, properly
compacted and surface patched with acceptable cold patch material. The City will remove ternporary patch and place hot mix blacktop in the
spring there will be an additional fee.
7. Trenching and Pavement Restoration Standards
r All asphalt pavement excavations shall be saw cut to provide clean, uniform edges.
o Sub{rade backfill shall be placed and compacted in accordance with minimum compaction standards.
. Stone rubble sub-base shall be installed and compacted to a minimum depth of twelve inches (12") (rubble may be supplied by the
City).
. Top course hot-mix asphalt (NYS DOT Type 6 or 7) shall be placed and compacted to a minimum thickness of four inches (4").
. Any trench excavation extending through an intersection or past a driveway shall be backfilled, compacted, and cold-patched the
same day until final restoration is completed.
8. Permit Glose0ut Requirement
The City shall not issue new permits to an applicant until all permitted work has been completed to the satisfaction of DPW.
Reminder. when installing a new water seruice line, the old service line must be disconnected atthe corporation.
9. Use of Gity Materials
Under no circumstances shall City-owned materials be used for private work.
10. Permit Moratorium Periods
No permits shall be issued during the following periods unless an emergency exists and written authorization is granted by DpW:
May 29 through June 8
June 26 through Labor Day
November 15 through the winter months
11. Water Tap
A MINIMUM of 48 (forty-eight) hours notice will be required for tapping water mains in non-emergency situations.
12. Compression Fittings
Plumbers are required to use compression fittings. Use of compression fittings will avoid a poor flaring and are easier to work with during
emergency repairs.

Any excavation left overnight shall be properly secured by the permittee using their own equipment, including barricades, signage, and lighting'
The permittee shall remain fully responsible for the excavation until final restoration is complete. Excavations shall not be left open if work is not
scheduled to resume the following day.
14. Curb Card
plumbers must submit a detailed drawing on the attached form of all new services (both water and sewer) showing measurements to curb box,
point of connections and point of entry into house.
15. Traffic Control and Closures
prior to any street or lane closure, the permittee shall submit a written traffic protection and maintenance plan for approval by the Saratoga
Springs police Department. The plan shall ensure safe and efficient movement of vehicles, pedestrians, and bicycles; maintain emergency
vehicle access at all times except during approved fulr closures; comply with the Manual on uniform Traffic control Devices (MUTCD) and all
applicable local and DOT standards; and be site-specific, identifying all impacts to the rightof-way. The plan must include the dates and times
of the proposed closure. Any closures outside of the approved dates and times require prior approval from both the Police Department and the
Department of Public Works.
16. Adjacent PropertY Access
Approved closures may temporarily affect adjacent properties. The permittee shall coordinate with all affected property owners and shall
maintain reasonable access to the extent practicable throughout the duration of the work. Sidewalks shall not be closed over the weekend in
congested areas.
17. Required Notifications
When closing a street, the permittee shall notify the Fire Department, Police Department, Emergency Corps, and School Bus Garage' DPW
shall be notified at least one (1) day prior to the closure.
18. Extended Road or Lane Closures
Any road or lane closure exceeding one (1) week may require submission and approval of a separate Permit Application for Temporary Closure
or Use of the Right-of-Way for Non-Standard Purposes, as determined by DPW'
19. lnsurance Requirements
lnsurance Certificates must be provided each year prior to any work commencing on a City Street. The certificate must name the City as an
Additional lnsured on a primary and Non-contributory Basis AMD Certificate Holder. See the insurance requirements section on the first page.
20. Requirements for Water and Sewer Line Work
Any work being performed on a water or sewer line must be done by a licensed plumber, a contractor approved by the City, or lnspected by an
Engineer.
21 . City Trees
Any disturbance to City trees or tree roots shall require prior consultation and approval from the City Arborist.
22.Plan Submissions
Applications must be submitted at least three (3) business days, before project is to commence, for approval. lf this is an emergency, please
contact our DPW Garage M-F at (518) 584-3356 as soon as possible.
23. lnspection Authority
DPW may require full-time inspection during restoration at the permittee's expense.
24. Pavement Restoration Permits
It is the applicant's responsibility to make sure permit and traffic protection and maintenance plan is approved before work is to commence.
ContractorTExcavator is sole[ rLsponsible for the job site and all utilities should remain undisturbed, unless the permit authorizes work on the
utilities. ln the event of an emergency, including but not limited to a leaking or broken: corporation, water main, water valve, fire hydrant, sewer
main, and/or storm main, the City of Saratoga Springs DPW Utilities Department shall be contacted to make the appropriate repair, The charge
for the emergency repair will be based off the current City fee schedule for DPW labor and equipment.
25. Permit Revocation
DPW reserves the right to revoke any permit at any time. Upon notice of revocation, the permittee shall have forty-eight (48) hours to remove all
equipment and mateiials from the right-of-way. Failure to comply may result in removal by the City, with all costs billed to the permittee.
