Hi Susan, thanks for the message.
As required by the property's Site Management Plan, DEC was notified of this change of use in
November. This involved a description of the project and a work plan and a phone conversation. DEC
is supportive of this plan and has said it would be straightforward with only a few minor requirements:
*No trees should be planted on the raised ground cover area (trees will only be placed on the sides in
non-previously-contaminated places)
*Any digging in the raised ground cover area should follow usual procedure for disposing of material
(no digging in this area for any reason is proposed or required for implementation of this plan)
*Testing wells will be adjusted and brought to the new ground level so that they can be continued to
be used without sticking up.
Considering it's been 60 days+ since our last communication, and their last message was an
affirmation of their comfort with the project, there is no obstacle here. They know how to get a hold of
me, and I'll be in touch with them annually for the required reports.
One thing they did explicitly ask is if we were being pressured or obstructed in any way by the city.
They are sensitive to the possibility of prejudice against Brownfield sites. My answer was no.
