As you are further aware, after completing a twelve year extended application process with the New York State Department of Environmental Conservation Brownfield Remediation Program for the site, Putnam Resources has been awarded a Certificate of Completion from the New York State Department of Environmental Conservation. Putnam Resources is in the final stages of completing construction and financing arrangements with Vecino Group in Troy, New York, and Bast Hatfield Construction in Malta, New York for construction of a building on the site in conformance with our existing site plan and DEC approvals. We have serious concerns that must be addressed prior to the Planning Board giving further consideration to the pending interim use application to build a park. We received a letter from our environmental engineers this morning, indicating that a further application to DEC, amending our existing approvals, would be necessary in order to proceed with the interim park concept. A copy of that letter is attached. As Co-Manager I can advise you that Putnam Resources LLC would not approve any application that would alter the existing DEC approvals which has taken us over ten years and millions of dollars in investment to secure. Moreover, were the Board to proceed with consideration of the interim park application, we would be concerned that the future of the approved housing use would be compromised, in the absence of written assurances that such an application would not alter, amend, suspend or otherwise diminish the existing site plan approvals. If this were to be the case, Putnam Resources would likewise not authorize this application. Until both the DEC and site plan approvals, as expressed in this letter, are resolved, the Board should take no action on the interim park proposal. In closing, I commend my Co Manger’s efforts to beautify the property and make it available for enjoyment by the community, while we are finalizing arrangements to complete the original mission and goals we set out on back in 2013. However, of paramount importance is that our existing DEC and Planning Board approvals are not disturbed.
