Per your request for an advisory opinion, the Planning Board considered the following application at their February 13 and March 20, 2025 meeting: ZBA #20220202 31-33 MARION AVE. STEWART’S AREA VARIANCE, Consideration of SEQRA Review and advisory opinion to the ZBA for an area variance associated with the demolition of the existing Mobil station and car wash, and construction of a new convenience store, gas canopy, and commercial tenant space in the Tourist Related Business (TRB) District. Following discussion on March 20, 2025, the Planning Board resolved the following: Motion to issue a favorable advisory opinion – passed 6-0 (Ferrante, Mayo, McTygue, King, Stellato, White) with the following recommendation: The applicant has offered to restrict future development of the portion of the property to the north approximately 210 LF from the project by conservation easement. This restriction would provide a buffer from the commercial uses on the property to the residential uses to the north and west. The Planning Board recommends that any approval(s) include a condition that references the conservation easement and identifies when in the land use board and permitting process it should be finalized and filed.
