NOTICE OF DECISION
In the matter of the application

353-365 Broadway Construction
353-365 Broadway
Saratoga Springs, New York 12866
involving Historic review of new construction of a two-story spa building and outdoor pool and modifications to an existing structure
within the Urban Core (UC) District, tax parcel #165.67-1-70, within the City of Saratoga Springs.
In accordance with 6 NYCRR Part 617, the Design Review Board classifies this request as a SEQR:
Type II action – exempt from further SEQR review
And, in accordance with the objectives, standards and guidelines contained in the Unified Development Ordinance Article 240 -
13.9 Historic Review Applicability and Approval Standards, the Design Review Board issues the following decision on December
10, 2025:
Approve the mass and scale with the following conditions:
Mass, scale and footprint of the building are approved contingent on the front setback on Washington Street be
increased by two feet.
Note: this approval shall expire 18 months from the issuance date unless any necessary building permit has been issued and
actual work begun.
Record of vote:
motion to approve made by G Wood, seconded by JGritsavage: passed 7-0
In favor: CBennett, LDiCarlo, JGritsavage, KCavotta, G Wood
Opposed: TEhinger, RDuBoff
As a result of this decision, the applicant:
may proceed with the proposed project as approved
