NOTICE OF DECISION
IN THE MATTER OF THE
APPLICATION #20250605 OF
SPEARMACO REALTY, LLC
28 GARFIELD AVE. AND 34 EAST BROADWAY
SARATOGA SPRINGS, NY 12866
Involving the premises with Tax Parcel ID# 178.52-1-14, 178.52-1-12.1, 178.52-1-12.2, in the City of Saratoga
Springs, on an application for final plat review of a proposed three-lot subdivision in the Urban Residential – 2
(UR-2) District with the Planning Board who met on September 25, 2025 and made the following decision(s):
In accordance with SEQRA regulations 6NYCRR Part 617 and after review and evaluation of the SEQRA
Short Environmental Assessment Form Parts 1 and 2, the Planning Board issued the following decision on
September 11, 2025 – passed 7-0 (Ferrante, Mayo, McTygue, King, Stellato, White, Johnson);
Issue Negative SEQRA Declaration
And, in accordance with the purpose and objectives set forth in the City’s Unified Development Ordinance Article
14 “Subdivision Approval”, the Planning Board issued the following decision on September 25, 2025 – passed 7-0
(Ferrante, Mayo, McTygue, King, Stellato, White, Johnson);
Approve final plat (dated, July 8, 2025) with the following revisions and conditions:
1. Improvements to Garfield Ave. (tree clearing, road improvements, street trees, street lights) shall be subject
to approval by DPW and via administrative action by the Chair.
2. Applicant shall identify existing significant trees to be removed and submit a tree replacement plan subject
to approval via administrative action by the Chair.
3. Install sidewalk across Garfield Ave. aligning the existing sidewalk and new sidewalk along East Broadway.
4. Install one pedestrian street light along East Broadway.
5. Final plans shall be to the satisfaction of DPW.
The applicant is required to complete the following prior to signing of the final plat by the Planning Board Chair:
Deliver a letter of credit or cash escrow as a performance guarantee to the City for required on- and off-site
improvements.
Submit a fee in lieu of dedication of recreation lands for one (1) new residential unit ($2,000)
Submit one (1) mylar and two (2) paper copies of the final approved subdivision plat for signature by the
Planning Board Chair.
File the signed final subdivision plat with the Saratoga County Clerk within sixty-two (62) days as provided in Article 3,
Section 32 of General City Law.
Approval of the final plat expires within one year after the resolution granting such approval unless all requirements
stated in such resolution have been certified and completed per Article 14 of the UDO.
