from the determination of the Building Inspector involving the premises on Lexington Road in the City of Saratoga
Springs, New York being tax parcel numbers 166.19-1-1 through 41 on the Assessment Map of said City.
The applicant having applied for an area variance under the UDO of said City to permit the consolidation of a
subdivision of land at the extension of Lexington Road into 13 parcels (identified herein as lots 2 - 14) in the Rural
Residential (RR) District and public notice having been duly given of hearings on said application on September
9, 2024 through November 17, 2025.
In consideration of the balance between benefit to the applicants with detriment to the health, safety and welfare
of the community, I move that the following area variances for the following amounts of relief:

As per the submitted plans or lesser dimensions, be approved for the following reasons:
1. Achievability by Other Means: The applicant has demonstrated this benefit cannot be achieved by
other means feasible to the applicant. The applicant would like to consolidate a previously approved 40
lot subdivision into 13 lots. This is due to an increase in wetlands since the original approval of 40 lots.
Several alternatives have been considered, and there is no additional land available for purchase.
2. Undesirable Change: The applicant has demonstrated that granting this variance will not create a
significantly undesirable change in neighborhood character or detriment to nearby properties. The Board
finds that while there will be an increase in neighborhood traffic, the applicant has demonstrated that the
sizes and locations of the planned single-family homes will preserve the neighborhood character.
3. Substantiality: The Board finds that the requested variances are substantial, however, the substantiality
is greatly reduced from the originally approved 40 lot development. The proposed 13 lots will create a
new neighborhood and, per the applicant, relief from the minimum front yard setback requirement is
needed to meet the important objective of keeping the homes a sufficient distance from the federal
wetlands located on the rear of the lots while allowing room for a modest rear yard.

4. Adverse Effect or Impact: The Board finds that these variances will not have significant adverse
physical or environmental effects on the neighborhood or district. Per the applicant, natural buffers to the
adjacent neighborhood and wetlands will be maintained. The 13 proposed single-family properties will
be able to maintain minimum permeability.
5. Self-Created Difficulty: The alleged difficulty is self-created insofar as the applicant’s desire to
consolidate a previously approved subdivision, but this is not necessarily fatal to the application.
Notes:
1. Negative SEQRA declaration by the Planning Board on October 30, 2025
2. Lots 2, 13, and 14 should not be further subdivided

This variance shall expire 18 months following the filing date of such decision unless the necessary
building permit has been issued and actual construction begun as per the Unified Development
Ordinance.
I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning
Board of Appeals of the City of Saratoga Springs on the date above mentioned, six members of the Board
being present.
