from the determination of the Building Inspector involving the premises at 253 Nelson Av e in the City of Saratoga
Springs, New York being tax parcel number 166.53.1-70-2 on the Assessment Map of said City.
The applicant having applied for an area variance under the UDO of said City to permit the construction of a
small pool and accessory shed in the UR-3 district and public notice having been duly given of a hearing on said
application on October 27 and November 17, 2025.
In consideration of the balance between benefit to the applicants with detriment to the health, safety and
welfare of the community, I move that the following area variances for the following amounts of relief:

As per the submitted plans or lesser dimensions, be approved for the following reasons:
1. Achievability by Other Means: The applicant has explored alternative sizes and designs and determined
that the proposed 7x13 foot pool/spa (91 sq. ft.) is the minimum size that will meet the owner’s needs. The
proposed 143 sq. ft. accessory structure is needed to house mechanical equipment and reduce neighbors’
potential noise concerns.
2. Undesirable Change: There are several pools of comparable or larger size in the immediate
neighborhood. The Board finds that the proposed pool and accessory structure are in character with other
homes in the vicinity. The pool and accessory structure would be located in a fenced side yard and will not be
visible from the street.
3. Substantiality: The Board finds that the variance is not substantial, and is further mitigated as described
above.
4. Adverse Effect or Impact: The Board finds that this variance will not have significant adverse physical or
environmental effects on the neighborhood or district. Permeability requirements will be met
5. Self-Created Difficulty: The alleged difficulty is self-created insofar as the applicant’s desire to build a
pool and accessory structure, but this is not necessarily fatal to the application.

NAYS: 0
This variance shall expire 18 months following the filing date of such decision unless the necessary
building permit has been issued and actual construction begun as per the Unified Development
Ordinance.
I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning
Board of Appeals of the City of Saratoga Springs on the date above mentioned, seven members of the
Board being present.
