In accordance with 6 NYCRR Part 617, the Planning Board classifies this action as Type II and exempt from further SEQRA review. Having properly noticed and conducted a public hearing on October 17, 2019, as required, on the proposed use; And, upon evaluation of the application based on the City's enumerated criteria to ensure that the proposed use(s) will not adversely affect surrounding properties and community character; And, in accordance with requirements set forth in the City Zoning Ordinance, chapter 240, article 7. I "Special Use Permit", the Planning Board issues the following decision on October 17, 2019 (passed 7-0-in favor: Torpey, Totino, Bristol, Fabozzi, Horton, Boivin, Bonitatibus): Approve with the following conditions: . One-way, exit-only from the site on to W. Circular St. 2. No drive-through facility — walk-up ATM only. 3. Site shall comply with ADA accessibility requirements. 4. Applicant to either remove the portion of the existing patio that encroaches in the City ROW along Ballston Ave. and W. Circular St. or petition the City Council for an easement to maintain the existing encroachment. 5. The Planning Board notes a desire for civic space at this location — specifics to be determined during site plan review. 6. Recommend that CDTA consider the site for a new bike share location. Note: this approval shall expire 18 months from the issuance date unless all conditions have been complied with and actual work begun.
