Subject: Application of Kalman —Variance —5 Tomahawk Lane
Parcel 192.12-1-65
Dear Board members:
I reside next door to the applicant. My parcel is the .862 property to the south and west of
the applicant. I am completely opposed to the approval of this variance and ask that it not
be approved. The new construction will be between my property and the lake and will block
my views of the lake which I currently enjoy. The variance permitting additional height
exacerbates the obstruction.
I have attached a current google map satellite view of the parcels which shows the relation
between my property and the applicant parcel demonstrating that the new construction to
be placed on the existingwalkway of the applicant will be directly between the lake and my
property. (attachment 1).
About a year ago the applicant went from a shared drivewaywith their neighbor to the north
to two separate driveways. The driveway they installed is substantially on my property. I did
not know this until I had a surveyor check on this over the summer. The corner pin of that
work places their blacktop 8' on our land. I am going to seek removal of that driveway and
expanded encroachment on our land immediately. The surveyor placed a pin showing the
boundary line while he was on the premises. I have attached a photo that I took this
morning of the location of the pin which I have made easier to see by my placement of a red
cup next to the boundary pin.(attachment 2). 1 now regret that I did not pay additional funds
to my surveyor (Santo Associates) to generate the paper survey that would show the
encroachment. I am now doing that but there is not enough time to obtain that survey by
tonight. I do note that the applicant has not submitted a survey by a licensed surveyor to
show ownership of the driveway as a part of the application.
We only received this notice on Thursday November 13th. This has not given us adequate
time to have our engineers and surveyors look at this to verify permitted height in relation to
the code. If the height calculations are incorrect as we believe it might be that would also
lessen the height of this building.
The variance should be denied as should any application for a building permit pending
confirmation of access by the applicant. Please table this application until these issues are
resolved.
