NOTICE OF DECISION
IN THE MATTER OF THE APPLICATION

Involving the premises at 24 Fifth Ave. with tax parcel #166.61-2-55, in the City of Saratoga Springs, on an application for a
permanent special use permit for conversion of an existing accessory structure to a historic carriage house dwelling in the
Urban Residential (UR-1) District.
In accordance with 6 NYCRR Part 617, the Planning Board classified the action as a Type II SEQRA Action:
(11) construction or expansion of a single-family, a two-family or a three-family residence on an approved lot;
Having properly noticed and conducted a public hearing on September 25, 2025 as required on the proposed use;
And, upon evaluation of the application based on the City’s enumerated evaluation criteria to ensure that the proposed
use will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City’s Unified Development Ordinance, article 13.4
“Special Use”, the Planning Board issues the following decision on September 25, 2025 (passed 4-2 – in favor: Ferrante,
Mayo, Stellato, Johnson):
Approve a permanent special use permit for a historic carriage house/barn dwelling as presented.
Note: The special use approval expires within 18 months of the date of approval if a building permit has not been
issued.
