This change will be documented on the final plans submitted to the City. • Regarding the potential easement between our “loop” road and the County property that leads west to the railroad, I offer the following explanation. In 2019 the effort was made to turn over the “loop” road to Saratoga County making it part of the existing Couty property referred to as Old Geyser Rd. At the time this effort was put forth, Saratoga County was not willing to take the property due to legal reasons with maintenance and exclusive use by only the railroad. We then analyzed granting an easement which came back as useless due to the fact that railroad personnel are not allowed to cross private property to access their sites even if easements are granted in their favor. Therefore, after months of effort the idea of making this feasible for the railroad to use for access was dropped mutually by the County, City and ourselves. Please note that County Attorney Dorsey, County Engineer Manz along with our attorney, worked very diligently to find solutions to this issue. • Regarding additional screening along the southern edge of the site, a revised plan (C 161) with more screening as attached for your review. We do not oppose suggestions regarding other methods by either the County or City Planning Board. Please feel free to reach out if you need any clarification or further information.
