Dear Kevin Weed:
I have reviewed the wetland delineation map entitled “WETLAND DELINEATION MAP -
TAX MAP PARCEL SBL: 165.-2-76.2”, dated September 23, 2016. The wetland boundary
on this map accurately depicts the limits of wetlands on the parcel(s) referenced below as
verified by the Department of Environmental Conservation (DEC). As noted in the table
below, the following wetlands are regulated by DEC pursuant to Article 24 of the
Environmental Conservation Law (ECL). Specifically, Wetland B is within a census
designated urban area and is contiguous with a previously mapped wetland.
The table below identifies the orientation of jurisdictional wetlands and adjacent areas within
the parcel, the wetland class, and the classification characteristic(s).

Wetland B is along the western border of the
property. The wetland continues offsite to the
west, northwest, and southwest.
Class II: Within a census
designated urban area
The wetland boundary validated by the DEC, as well as the jurisdictional determination,
remains valid for five years from the validation, dated 7/15/2025 (through 7/14/2030). For
official use of the wetland boundary after this five-year period, the boundary must be re-
validated by DEC staff. This may include additional flagging and a survey of the wetland
boundary if changes are noted.
A freshwater wetlands permit from DEC is required for any regulated activity planned or
proposed to be undertaken within regulated wetlands or their regulated adjacent areas.

Please note that this determination pertains only to state-regulated, freshwater wetlands
and regulated adjacent areas. DEC also regulates protected streams, tidal wetlands,
coastal erosion hazard areas, and other important environmental resources. Work affecting
those areas may also require DEC permits. More information on other DEC permit
programs is available online at https://dec.ny.gov/regulatory/permits-
licenses/environmental-permits.
Pursuant to ECL section 24-0301(4), there is a rebuttable presumption that areas meeting
the definition of Freshwater Wetland are regulated and subject to permit requirements. If
you believe this jurisdictional determination has been made in error, you may request a
consultation with DEC by scheduling a meeting on the parcel or property with the
appropriate regional office to review the jurisdictional determination, pursuant to 6 NYCRR
664.9.
