Comments As we indicated in February, 2021, when a proposed
renovation of this structure came before the ZBA, we are
concerned about the carriage house conversion proposed for
24 Fifth Ave (29 Tipton Lane). At that point the project was
described as a “home office.” It is now described as a “carriage
house dwelling” that includes a full bath and small kitchenette,
enough to make it a possible rental space.
Since the carriage house sits almost literally in our back yard,
we want to be sure it will not be used as a rental or Air B&B

(including by potential future owners). The attached photo
looking into our yard shows our house on the left, our garage
on the right, and the carriage house straight ahead. It is very
close.
At the 2/1/2021 ZBA meeting, the owners’ architect Dennis
McGowan of Balzer Tuck noted:
“A half bath is proposed with the addition of a toilet and a sink
only. Access from this area to the attic space will also be
provided. Elevation views were provided to the Board. The goal
of this project is to provide office space for the homeowners
who own several businesses as well as volunteer and
philanthropy work. This would provide a quiet space outside the
home. There is no intention for customers, clients, or parking to
occur on the site.” [Minutes of ZBA meeting]
Also from the 2/1/21 ZBA meeting:
“Mr. Balzer stated this will not be a rental property or a Bed and
Breakfast or a future residence which will be written into the
variance we receive, and the applicants are fine with it.”

It is not clear to us if that language regarding approved usage
of 29 Tipton Lane was included in a variance.
