Siding Replacement
A. RECONSIDERATION OF EXISTING WOOD SIDING REPLACEMENT
• Hazardous Materials Survey report dated 07.16.25 and
performed 06.04.25 indicated the red paint on the exterior wood
lap siding contains asbestos containing materials.
• Trace amounts of asbestos are a hazard when disturbed
(sanding, scraping, or demolition).
The applicant has previously agreed to restore the wood siding at the
front (East) elevation. In light of this new information, the applicant
wishes to remove all existing wood lap siding and replace in kind with
new painted wood lap siding for the future well-being of the 2-4 year old
students and their teachers.

Education Code Compliance and Safety
Concerns
B. EDUCATIONAL CODE COMPLIANCE AND SAFETY CONCERNS
• NYS Building & Fire Regulations For VRNS (Voluntary Registered Nursery Schools)
• 125.3 (g) (1) Safeguards shall be provided to protect children against injury on account of low
windows , exposed pipes, hatchways and window wells.
• 125.3 (g) (6) Windows and doors shall be openable and equipped with safety devices. Effective
means of eliminating insects shall be provided.
• Manual of Planning Standards 2022 (State Education Department)
• S106-2.b. Every space of pupil occupancy over 500 square feet in area, shall have two separate
means of egress from the space,each into a separate smoke zone. The primary means of egress
is commonly the opening to the corridor. The second means of egress may be a door into a
separate smoke zone or to the exterior, or a rescue window . [...]
• S106-4.a. Emergency rescue windows, as required in S106 -2, shall be windows of such size and
design that will permit and facilitate emergency egress through them. Window hardware shall be a
maximum of 54 inches above the floor. It is recommended that all classroom windows permit
emergency egress.Double hung, casement, and sliding windows are satisfactory window types.
Casement windows must have hardware that permits the window to open at least 90 degrees.
• S202-1.a.1. All interior glazing less than 60 inches above the floor shall be safety glazing.

Double Hung Window Replacement
C. DOUBLE -HUNG WINDOW REPLACEMENT
The DRB requested that we restore the two existing double -hung wood windows at the second
floor classroom of the front (East) elevation. We want to outline our concerns and limitations:
1. Educational Code Compliance & Safety Challenges
a. Low sill height (+/-26") triggering the requirement for Window Opening Control
Devices (WOCDs) to prevent children falling.
b. New safety glazing must be installed to prevent injury to children and staff.
2. Windows tested positive for lead paint.
3. Windows do not meet energy code, even with storm windows. Heat loss, drafts, and
condensation increase energy demands and reduce comfort, especially during the
winter and summer.
4. Operation, Maintenance and Liability
a. Retrofitted WOCDs, glazing, and weather seals may hinder operation and
increase likelihood of failure.
b. The school would assume long-term liability for hardware performance and
child safety, most importantly in cases of emergency.
Therefore, the applicant wishes to not restore the double-hung windows and instead replace
with aluminum clad wood double -hung windows.

Double Hung Window Restoration
D. DOUBLE -HUNG WINDOW RESTORATION
Given the previous information shared, if window restoration of the (2)
existing wood double-hung windows is still required, we will provide the
following:
1. Window opening control devices to be retrofitted (Andersen
WOCD Spring Loaded Catch or Angel Ventlock Side -fixed WOCD)
2. Work with window restorers Harry Judge and Peter Reylea:
a. Provide lead abatement with industrial strength methylene
chloride (note that individual pane cannot be replaced for
safety glazing (per DRB mockup request) due to intensity of
abatement process)
b. Modify sash weights as required.
c. Note that window restorers not willing to assume liability
for the future operation and safety of these windows.
3. Safety film to be applied to existing glazing (3M Scotchshield
Safety & Security Window Film Ultra 800)
4. No storm window to be provided to allow for emergency egress
(exterior egressable storm windows not available).

Inswing Casement Window Replacement
E. INSWING CASEMENT WINDOW REPLACEMENT
The applicant requests that thay be allowed to replace the existing wood
inswing windows at the second floor dormers (South and North elevations)
for the following reasons:
• Window opening control devices that allow egress do not exist for
inswing windows.
• Retrofitted WOCDs, glazing, and weather seals may hinder operation
and increase likelihood of failure.
• The school would assume long -term liability for hardware
performance and child safety.
• Window restorer Harry Judge expressed concern for liability due to
requirements for both window limiter devices and emergency egress.
• New compatible units allow safe, secure, low -maintenance operation
with integrated required safety features.
