NOTICE OF DECISION

Involving the premises with tax parcel # 165.-2-85, in the City of Saratoga Springs, on an application for a
permanent special use permit for a vehicle dealership — enclosed only in the Neighborhood Center (T-5) District.
In accordance with 6 NYCRR Part 617, the Planning Board classified the action as a Type II SEQRA Action:
• (18) reuse of a residential or commercial structure, or of a structure containing mixed residential and
commercial uses, where the residential or commercial use is a permitted use under the applicable zoning
law or ordinance, including permitted by special use permit;
Having properly noticed and conducted a public hearing on January 11, 2024 as required on the proposed use;
And, upon evaluation of the application based on the City's enumerated evaluation criteria to ensure that the
proposed use(s) will not adversely affect surrounding properties and community character;
And, in accordance with the approval standards set forth in the City's Unified Development Ordinance, article
13.4 "Special Use", the Planning Board issues the following decision on January 11, 2024 (passed 5-0 — in favor:
Pingel, Marshall, McTygue, Morrison, King):
121 Issue a permanent special use permit to use a portion of the existing building for used car sales — office and
enclosed storafze of vehicles for sale — to be located within the rear, interior tenant space (approx. 1350 sq. ft.).
Condition:
• Applicant shall submit an application for site plan review for administrative review by the Planning Board
Chair.
Note: this approval shall expire 18 months from the issuance date unless all conditions have been complied
with and a building permit issued.
