Mayor Safford and Members of Saratoga Springs City Council,
On Thursday, February 8tn the Planning Board issued a SEQRA Negative Declaration and Special Use
Permit for outdoor dining to Treehouse Brewing for its proposed operation at 3376 Route 9 (South
Broadway). This location is between Saratoga Honda and the Homewood Suites on the east side of
Route 9, just south of Crescent Avenue.
During the deliberation of the application, the Planning Board identified a number of issues that are
more appropriately addressed by the City Council than would be by the Planning Board and the
applicant. The concerns primarily relate to the solicitation of the New York State Department of
Transportation (NYSDOT) and are enumerated below:
Reduction of Speed from 55 MPH to 40 MPH: the Planning Board believes the introduction of
pedestrian activity to this portion of South Broadway should simultaneously warrant the
reduction of speed in this corridor. The reduction from 55MPH to 40MPH should start to the
south at the signal for the East West Road (State Park entrance) and continue to the north of
project site. The reduction in speed will also facilitate safer operation of the proposed

Installation of Pedestrian Crosswalk along Southern Side of Crescent Ave: this improvement is

outside the realm of the Site Plan but important as'pedestrian activity introduced. The
proposed Crescent Avenue Connector may also include this element but the
timing/coordination outside our understanding as it relates to this project.
3. Improvements in the Right of Way: currently, there is a sidewalk along the frontage for
Saratoga Honda and the Homewood Suites and the Treehouse project will tie into those,
eliminating a missing link. There's no mechanism for the Planning Board to require activity on
private development with existing approvals and the use of the Right of Way in this corridor may
prove vital for connection to the Crescent Avenue Connector and widening the pedestrian
accommodations to ensure continuous width. Previous project experience indicates that a
request of the legislative body may incentivize NYSDOT's alteration of improvements along the
three properties and how they relate to the Crescent Avenue.
