IN THE MATTER OF THE APPEAL OF

Based on the submitted evidence that the application for an extension of a granted area variance does not differ
from the original application and approval, and that there have been no changes in the condition of the property or
neighborhood warranting otherwise, the Board moves that the application of B&D Properties, LLC, for the property
located at 126 West Avenue in the City of Saratoga Springs, and identified as tax parcel 165.72-1-22.1, for the
construction of a mixed use development in the Urban Neighborhood District (T-4), be approved.
The variance was originally granted on July 25, 2022 and extended once. The Board moves that the variance
approval be extended for 18 months from the date that such resolution expired, July 25, 2025 with the new expiration
date to be December 23, 2026. The variance shall expire on December 23, 2026 unless the necessary building permit
has been issued and actual construction begun as per the UDO.
It is so moved.

This variance shall expire 18 months following the filing date of such decision unless the necessary

Board of Appeals of the City of Saratoga Springs on the date above mentioned, seven members of the Board
being present.
