Comments Allowing this variance would set an unwanted precedent,
because there are no comps for this in our neighborhood.
Overturning this denial would create the first comp, and then
there would be no grounds for denying similar projects that
came up for review. Granting this variance would allow owners
/ builders to apply for accessory structure permits and then
reapply at a later date for a variance to convert them to
residential living spaces, Essentially circumventing the

permitting process for building a residential structure. As with
the Crenshaw structure, formally the Witt residence, the
accessory structure towers over the neighbors house as does
the accessory structure at 199 West Circular. An accessory
structure being listed as a garage or shed is a Non-habitable
structure and should remain as such, especially if the lot size
does not allow for two residential structures to occupy the same
lot. There is a reason why residential setbacks exist. This
would open the door for others to do the same, which not only
affects quality of life for neighbors within the city, but there’s
also a safety issue, Fire Safety being high on the list and the
potential for fire spread or damage to adjacent structures. As a
25 year firefighter, battalion, chief, code enforcement official the
risk is real. Allowing a variance of this nature would just lower
the quality of life for the citizens in neighborhoods within
Saratoga springs, while at the same time increasing the
potential safety hazards that come with allowing such density
within neighborhoods. Thank you for your time and
