provided.
Lew Benton noted that a recreation fee of $500 (1 new lot X $500/lot) is due.
Nancy Butcher moved and Lou Schneider seconded the motion for a negative SEQR
determination. The motion carried (6-0).
Bill McTygue moved and Lou Schneider seconded the motion to approve the subdivision
contingent upon the items agreed to during the discussion. The motion carried (6-0).
2. 03.027 ARTIST CO-OPERATIVE: 79 Beekman Street
This is an application for a special use permit for an art gallery, eight artist studios, an outdoor
exhibition space, a business office, and waiver of on -site parking in the Neighborhood
Commercial District.
Appearing before the Board was Amejo Ameyot and Mary Zlotnick, applicants.
Geoff Bomemann notified the Board that the applicant appears to have failed to notify one of the
neighbors that owns property within 250 feet of the site. Because of this, the Board is not able to
make a decision tonight and the public hearing will have to be continued to the April 2, 2003
meeting.
Proposed uses: Amejo Ameyot said that this site is currently a two-family home. She said that
the proposed art gallery would be located in the front of the home and the small studios would
be located upstairs. She said that the bedrooms would remain unchanged and they are not
tearing down the walls. She said that this building would set precedence on the street. She
said that there are a lot of artists on the street and they feel their presence would turn the
neighborhood around and support the stores. She said there would be a classroom to teach
children on site. She noted that they already received feedback from discussions at the Saint
Michael's festival and they may even have a community dark room. Amejo Amyot said there
would be a small business office on the second floor. She said they would also like to have a
tent or canopy outside to create an artist workshop area in the backyard. She said that this
outside area would be ideal for clay artists.
Geoff Bomemann said that with past practices the Board has established some guidelines for
the use of the artist studios. He noted that the guidelines include no residential use of the
studio, restrictions on the types of artists and no open fire. Mary Zlotnick said they would agree
to those conditions and further noted that the artists at this facility would have to be on a list of
artists maintained by the Art Council.
Parking: Amejo Ameyot said that they are aware of the parking concerns and they have taken
them into consideration over the past two years that they have been thinking about this project.
She said if the street does develop with stores and galleries that there is parking available on
adjacent streets. She said that Lance Brewer owns some land on Ash Street and they
discussed renting parking space there. She noted that there are five spaces behind this
building, but it would definitely be an issue as the street grows.

Lew Benton, Chair, called the meeting to order at 7:00 p.m.
REPORT ON ADMINISTRATIVE ACTIONS BY THE CHAIR:
01.80 SPRINGWOOD APARTMENTS: 338 Ballston Avenue
Lew Benton said that in a request dated February 25, 2003 to applicant requested an
amendment to the architectural review approval granted on April 3, 2002 to make a number of
minor modifications that were required to meet building code or utility requirements.
Lew Benton said that in a response dated March 6, 2003 the Chair granted this request.
ANNOUNCEMENT OF RECORDING OF PROCEEDINGS:
Lew Benton said the proceedings of this meeting were being taped for the benefit of the
secretary. Because the minutes are not a verbatim record of the proceedings, the minutes are
not a word-for-word transcript of the recording.
COMMENTS FROM THE CHAIR:
Lew Benton noted that the City Council has approved a moratorium for the Weibel
Avenue/Gilbert Road area that will run through December 18, 2003 while the existing land use
policy in this area will be studied.
Lew Benton also noted that the City Council approved the zoning amendments that authorized
the new fees for development applications to fund the new staff positions of an Assistant
Building Inspector and an Assistant City Planner. Lew Benton said that the Board is grateful to

the City Council for taking that action. He said that he made a commentary to the Council in
support of approving the fees.
PRIVILEGE OF THE FLOOR:
Lew Benton asked if there was anyone in the audience who wished to speak on any planning
issues not on the scheduled agenda. No one spoke.
1. 03.026 KELLY SUBDIVISION: 54 Kirby Road
This is an application for a two -lot subdivision in an Urban Residential — 1 District.
Appearing before the Board was Gail Kelly, applicant.
Site history: It was noted that on February 26, 2003 the ZBA granted variances for the proposed
lot B because the mean width on lot B was not acceptable.
Layout: Lew Benton noted that there is a concern that with the creation of lot B the access to the
eastern portion of lot A from Glenwood Drive is closed. He said that there would only be access
to the eastern portion of lot A off of Route 29 and this was not a desirable access.
Nancy Butcher questioned the purpose of the subdivision and Gail Kelly said that lot B would be
for a single family home. Gail Kelly noted that lot A is her current residence.
Lew Benton said that the Board is concerned that the applicant is potentially denying access to
this parcel. Gail Kelly said that she has no intention of further subdividing lot A. Lou Schneider
suggested that a note be added to indicate that lot A shall not be permitted any direct access off
of Route 20 (Washington Street). Gail Kelly agreed to add this note.
Waivers: Gail Kelly requested a waiver of sidewalks, streetlights, trees, topography and the
letter of credit. The Board agreed.
Gail Kelly agreed to comply with all the technical issues as listed on the Board's agenda notes.
Lew Benton opened the public hearing.
Tent' McCarthy, 47 Kirby Road, questioned where the new dwelling would be situated. Gail
Kelly showed Terry McCarthy the subdivision plan and where the house on lot B would be
located.
There being no one else wishing to speak, Lew Benton closed the public hearing.
Lew Benton noted the following comments from the City departments: DPS comments: Fire
Department: No comments received. Police Department: "None." Traffic Maintenance: "No
comments." Code Administration: "No comments." DPW comments: No comments received.
Office of the City Engineer: "See comments on plans."
Lew Benton noted that the Saratoga County Planning Board referral is pending. He said that an
application fee of $450.00 has been paid. He said that proof of mailing for hearing notice to
