Comments Please uphold the Building Inspector's April 14 denial of the
issuance of an area variance for 36 Hyde Street, because it is
not zoned for occupancy. The lot adjacent to our own property
has a tear-down rental on it, and our concern is that if/when it is
sold, granting this appeal would embolden the buyer to similarly
circumvent law, codes, and process, and we could wind up with
an accessory ADU 5.3 feet from our property line. Granting this
appeal would send the message that while most people need

to follow established building and zoning processes and
procedures when asking for permission, a select few get to ask
for forgiveness instead,. Once this precedent is set, I'm not
sure what would stop other neighbors with detached
garage/storage units from converting their spaces into ADUs?
Please draw a clear line in the sand and uniformly apply and
uphold the current zoning codes and laws, regardless of who is
making the ask. Those of us that have lived in and enjoyed this
neighborhood for years have done so because of the safety
and protection that the zoning codes have provided, and we
therefore request the denial of this appeal.
Also, since application appears to be missing area variance
photos, and public comment page limits photos to 1 per
submission, I am submitting the view of the garage/storage unit
from behind the fence of 17 Birch.
